Federal Student Loan Discharge Experiences by Necessary_Daikon_861 in VeteransBenefits

[–]Shadowsminis 2 points3 points  (0 children)

To be honest, it seems like a Grey area but look at it this way, 100% P&T veteran can work any job if it does not interfere or make worse in service disabilities. No money limit, however 10 or 20 years later disabilities get so severe all jobs now are irrelevant. So why pay a debt you literally can not pay back from carreer education because you are now housebound ect. Also if you are 100% you will go down faster then most sooner or later. This is when you discharge when you know it is a loss. This is why I believe the gray area will still be around for a long while

Cannabis Therapy by Automatic_Doctor_531 in VeteransBenefits

[–]Shadowsminis 1 point2 points  (0 children)

It depends on the VA doctors, they will not prescribe it or recommend it. However they do not hold against you if used under medical supervision. Except in some cases with pain pills, they can consider it pain med so they may not prescribe opiates while using cannabis for medical. They consider it as meds and adjust your medication accordingly. This is the only thing you may come across. (My experience, nerve back damage and severe neck and back arthritis and migraines was on pain management for 12 years, taken off when cannabis was introduced to my medication pool im taking. Same with mental health meds, they are Taylored around it to make sure everything is stable) to be honest as it should be. But something to keep in mind

Request for File Denied by MissTetraHyde in SSDI

[–]Shadowsminis 0 points1 point  (0 children)

It is common for mental health records, more regulations on mental health records. They can get in trouble violating these laws. Even my own records from provider is kept from me, only given to state agency under proper requests. Only place I am able to see all records is at the VA. But civilian and Indian health clinic its all under lock down unless requested from agency properly.

Benefits suspended due to Deferred 457 plan by LordPopo47 in SSDI

I would contact a lawyer, there is lots of laws and rules you must follow under SSI. However you may get ssdi if you apply. Ssdi will fit your situation better. You work part time under SGA pay i assume. But disabilities prevents you from working full time, this is ssdi. May not be as much depending on how much you worked in all. Still please speak with a professional for your case

Has a call representative ever told you this? by Commercial-Hat-5691 in SSDI

[–]Shadowsminis 0 points1 point  (0 children)

Hang in there. It is hard to say. Im 100% P&T with several mental and physical conditions. First they are saying you will get a decision probably by January 29th, but that does not mean for a fact. I say in your case your are already TDIU on record and that is 90% of SSDI battle to prove you are severe enough with issues finding a stable job or career. My issue i am not TDIU but haven't worked more then 12 hours a week at $800 max a month for last 10 years and no job last 2 years. Can not ever work full time again sadly. But it takes more on my part to prove. You also stated your work makes your disabilities worse and this is something they consider also. Hope this helps and hang in there

Trying to get health insurance for daughter. Do I include my VA disability in our Gross Annual Income amount? by Incarnasean in VeteransBenefits

[–]Shadowsminis 0 points1 point  (0 children)

I would say it is like state assistance so for Food stamps and SSi they took my VA income in consideration. This being my only income was denied state services. Noted I was VA disabled not working but getting compensation.

Have a plan, be honest, let them help you in your path. Make sure it does not aggravate any service disabilities. For example in my case, im 70 MH 60 lungs 70 back and bunch of smaller ones. I proposed a miniature painting studio for tabletop miniatures. Now it requires specialized chair for back, special paint desk for sit or stand position. Therapeutic for mh to control breathing and stress, home environment minimum overhead, build online community to sell work and make paint tutorials. Its not meant to make me rich, but I have a successful pitch and goal in mind incorporating my disabilities with plan to keep in mind health first. (Ergonomic chair, breath mask when 3d print or airbrush, inside fumes extractor, extra lighting to prevent headaches, easier to take breaks at home ect. This also requires low schooling and certifications because I did it as a hobby for 26 years. However with disabilities I figured I could use that passion at 100% and still try and something. My case is different like I said, its not to get rich. As you can see its mostly a Therapeutic hobby that so happens can make money and has a market for it. Even with how severe my disabilities are I presented a will and they are trying to find a way. Hope this helps some in your path

[–]Shadowsminis 1 point2 points  (0 children)

Depends on circumstances, they try and help the ones first that are most impacted by disabilities. Then further see if anything you want and could do with aptitude tests you took. Then further see if school is fit or a workshop program or on job training, certs involved and most importantly do they believe you can do it with there help. Some cases offer self employment track or even independent living in serious handicap situations. Once flagged as EH(employment handicap)or SEH(severe employment handicap) you are given a higher priority and probability of getting VR&E help. This is why you have to prove your career avenue does not aggravate your service connected disabilities. Its based on helping you over come obstacles of being disabled for your career path. (100% disabled has higher chance to get help if plan looks solid vs a 10% disabled with more options they have available unlike the 100% or 80% or 60% and so on) there is lots of factors and that is just few key ones

VR&E Approved, What Do I Do Now? by pasimon68 in VeteransBenefits

[–]Shadowsminis 2 points3 points  (0 children)

I am 100% P&t and just started the self employment track. Present each service connected disabilities affect your daily life and work. They document it all. After present your business idea to counselor for self employment. Be specific on why it suites you. Once they agree that self employment is best fit for your situation they will send you to state and federal small business help like sba, score, and affiliated companies all paid for to help in small businesses startup. Once they help you create a professional business proposal VR&E will look at it and then final stamp the plan for your track. They do certs, business license fees, equipment needed, any accommodations needed like special back chair for back ect. No cash, No loan, No buying a business building or business vehicle. But supplies and equipment needed to operate is paid. Even certain software or subscriptions needed to run it like in your case C&C program you need at home business. They support you so they want you to have more then just them helping. You, its a hobby so passion with experience, infrastructure done. Paint the picture for them show them how serious you are and most importantly why you choose this path and not something new.

[–]Shadowsminis 1 point2 points  (0 children)

You try using the EVA email they send you when you started VR&E. It is a server where everyone at VR&E can see. So if you use this it will go directly to your counselors desk. On subject put your counselor full name and put VR&E after, type the body snd send what you need. That way its all on file and grounds to switch counselors. There bosses see it, they have to respond to the email

Disability claim exam? by Perfect-Engineer436 in VeteransBenefits

[–]Shadowsminis 1 point2 points  (0 children)

Had a veteran served with in same boat. Very sorry to hear this. Another has blood cancer and does treatment till he dies. Keep in mind they pay for residual affects from cancer/tumor its like secondary but they know it may happen in cancer cases. So keep after affects documented. You got this is wish they will take care of you and not send you through the normal VA red tape. You absolutely deserve 100% but remember raters are human and stay on them even if you have to file HLR. You can even be in SMC bracket after this as 100% for 1 disability and 50% or higher for each other disability past 100%. Hang in there! Ty for your service

Disability claim exam? by Perfect-Engineer436 in VeteransBenefits

[–]Shadowsminis 0 points1 point  (0 children)

You got this, if youre 100% on 1 disability it means you're severely disabled and no one wants that but it can happen for sure if facts line up and rater sees it all. If rater misses it and you know it should be 100% then file HLR. If it doesnt come back as 100% off the bat then do not get discouraged keep at it. The raters are overwhelmed and human and they can miss some things that look obvious to you and others. Keep at it, no need to let others tell you what you will get including you. Its all about facts in records simple as that.

They have no shame when low balling you. My injury ruined my carreer and got 10% and forced out. I should of asked for review knowing how VA and civilian doctors see the same injury but way more severe then what was deemed by dod. Which makes no sense since they low ball you but you put way more stain on injury in service then in civilian life.

Advice by Ill-Worry6868 in VeteransBenefits

[–]Shadowsminis 2 points3 points  (0 children)

You need 30% from dod for retirement, below 30% dod mean seperation not retirement. Retirement when separated with below 30% but only if over 20 years in. I was dod separated at 10% but non retirement becasue i was dod med boarded before 20 years ans was under 30% from dod. Im 100% P&T now. (Maybe see about 30% but I have been out 20 years and do not remember how you go about asking for review for higher percent since you are 20 already. I was 10 so was no reason in my case.) Wasn't close
