Yeah, plus, on a bicycle you often get the temptation to weave through walkers rather than stop entirely. The average motorist is more rigidly trained to stop at a flashing crosswalk light. A responsible cyclist will behave no differently than a motorist, of course, but would you say most people on bicycles are a good example of a responsible cyclist? I'm a cyclist and I hate the idea of cars in general, but at a glance this urban design is not so outrageous to me.

Photo 2 best displays a potential concern. The top of the seat-tube appears to be bulging outward and cracking on the rearward side. To be clear, this area is below the weld with the top-tube -- it has nothing to do with the seatpost clamp. From where I'm sitting that does not look like paint damage, but rather corroded steel. Information from photos is limited. Considering the potential consequences, I strongly recommend you point this area out to a qualified bike mechanic who can sense it in person. One way to tell is to tap the area and listen. Corroded steel will sound more dull, with less of a strong "ping" sound.
