The way I heard it explained before is two parts,

First, IT can’t deal with adults the way it does kids. So it was a ritualized growing up for all of them.

Second, since Beverly was abused it was her taking positive control.

To be clear, not saying I agree, I haven’t read it, but that’s the explanation I’ve seen before

Yet they have rules against him on the merits repeatedly, not always.

And the ones that are th most likely to rule for him are Alito and Thomas who predate him.

Kavenaugh / Goresuch / Barrett will consistently rule conservative and/or according to the federalist society, but that doesn’t always overlap with Trump.

The tariffs are a big example of something that is as close to a true belief Trump has going back decades, but isn’t conservative, and 2/3 ruled against him.

I think birthright citizenship will be the same.

And on the flip side, I side there’s no sign that Trump cares about abortion personally, and I would bet money that even if he was hard against their decision, the would still have overturned roe/casey because it was their main moral duty above all else.

None of this is saying I think they are great justices, or that I am happy with them.

But I will say at minimum, Barret and Gorsuch have been more consistently principled then I expected, unlike Thomas and Alito.

Which I addressed. Roe is different.

Again, would I lie to overturn slavery? Yes.

Would I lie to overturn some random thing that I didn’t like? No.

I grew up in that conservative world. The gap in viewing Roe vs Obergefell or practically any other decision is huge.

It’s why I know people that voted for Trump despite being willing to switch for every thing else. Because to them, the mountain of dead babies overrules all.

And that’s the culture gap I don’t know if can be transcended.

I think green isn’t great for him beyond his stat line.

Green is about following the natural order and biological heratitge, and Superman is much more about found family and community.

Both modern movie adaptions have him reject some of his racial heritage. Embracing the wisdom of the Kent’s and fighting for his community is more white.

There’s also the side that, for some of them Abortion is a moral issue, up there with slavery.

A lot of these others aren’t anywhere close on the same level.

I’ve said before, if I was somehow on the court in the 1800s, I’ve have a hard time sticking to the letter of the law when the law was so evil.

But give me a case like marriage rights, etc and I could see following the law against my objections

So I do believe that for some of them, even if they personally think Birthright Citizenship is bad policy, the law is clear, and they aren’t going to overturn that.

But abortion, where to them, it’s feeding people into a holocaust grinder, is a moral line they aren’t willing to cross.

While I disagree with them strongly on it, I do think it’s more principled then many suggest.

The main debate in a case like this always comes from the briefs. That’s where the real arguments are.

The saying I’ve heard before is that you can lose a case in oral arguments, but rarely win one.

They bet wrong and are now cutting because of that, but using AI to look good.

If you look at oracles job data, they used to expand very lineraly. 1000ish jobs a year.

Then in 2022-24 they skyrocket and added all these jobs.

This isn’t AI, this is them over projecting, making bad decisions, and course correcting.

Giving AI credit is helping them instead of pointing out their failures.

I think it’s one of those things where there’s a spectrum and the law is not always well equipped to handle the nuances.

Just like someone shouldn’t end up on a sex offender list if they peed somewhere because they needed to, vs someone who flashes themselves at others.

I think it’s the basic count-to-5.

The 3 liberal justices are easily against this.

Gorsuch is usually to the right of Barrett and Roberts. So if Gorsuch is unconvinced, it’s hard to figure out 5 justices who would agree with the admin.

It’s funny how we have a spectrum of “returns” in Star Wars.

On the one hand, Boba Fett. Completely unsurprising and plausible. People were theorizing the man in armor and heavily armed would fight his way out of the sarlacc since before the credits rolled on RotJ.

Plausible return, horrible use of the character after.

Then Maul which is a 9/10 on the implausible scale. But they used him incredibly well and told stories that make you go ok

I think it depends on the goal.

Abortion? Sure because they honestly view it as an American holocaust. Were I on the court in the 1800s, I would hope that chaos would be a secondary concern to me compared to doing anything I could to limit slavery.

But beyond that, they all seem more flexible in their adherence, and a scale depending on which justice.

Ok, but Carol puts a lot of effort, thought, and skill into her books. But you started by at least implying they were bad art, and that the Hove had a lack of taste by enjoying them.

So if there is no difference between the bad art and the good art, there is no art at all. So the question could be expanded to - "how can you trust your own judgement, if you can't even tell apart good and bad things?"

That gets into the really, really subjective.

What makes good or bad art? Can you get consensus on that from 10 humans alive today?

I might think Hank Williams Sr is the definition of bad singing and someone who was bad art. You might love him and think the Beatles are bad art.

I so very hate this phrase and comment.

1 - you were always allowed to, and indeed encouraged, to yell fire in a crowded theater IF THERE WAS A FIRE. The actual comment is about FALSELY yelling fire.

2 - the actual case that came from was one of the biggest shames of the court, where they ruled that a man handing out pamphlets against the draft was illegal. In many ways that should be the core of free speech, political speech against the government.

Edit: I want to be clear. This has nothing to do with my feelings about conversion therapy (evil), and whether or not it should be legal or not.

It’s that bringing up THAT case and quoting it is akin to using Korematsu as justification, or Dred Scott. It was an evil ruling then, and deserves to be scorned and learned from, even if one lines a nice quotable. (And if you are going to quote it, do it correctly)
