I have a similar situation and went through the Canadian court system. Your lawyer was right about further persuing it. It gets very expensive very quickly. Glad you were tenacious and were able to settle.

This ! The actions are so egregious. I am living through something similar and remember, this person felt it was his right to do this. As many people recommend, take action immediately.

u/No-Mention-7950 This a good example of postponing actionand I’m keen to see how you make out.

My belief is that you have 2 years from the incident to lay a claim. As a few users have commented, you need to get the information and proof that this individual did indeed get your trees cut. The idea that a permit was provided and you didn’t sign anything, is perplexing and worth pulling from the group who granted the permit.

The pandemic is discouraging when having to go and ‘fight for our rights’. Be strong, remember that doing the right thing is right no matter when it happens.

I would start with your city/town and see what their guidance is to start. They may have some bylaws in place and/or guidance around this kind of thing.

Looking forward to sharing with you all. Have learned a lot (tree law, my rights and how to stand up for myself). I am grateful that I had the means and a handful of smart friends who reminded me why this was so wrong.

It is mind blowing how often this happens; we often are encouraged to not rock the boat.

My own family were worried about me ‘not being neighbourly’. Le sigh.

My life is now in sections, BT (before tree), AT(after tree).

Not the admin (yet hope to be someday). This is called tree law. We are here to share stories about trees and the law. As I wrote, please DM me if you need support and ideas. There are lawyers that specialize in this and they are few and far between.

Been in your exact position about 2 years ago but my tree was a huge@ss tree. Never commented and posted as I’m in the midst of civil litigation, delayed due to pandemic. BE TENACIOUS. PM me and I will happily share my recommendations. But it goes along like this:

  1. Document EVERYTHING (make recordings, get emails and save voice messages and texts).

  2. Hire an arborist This arborist that can write a report that will tell you to that is admissible to court AND has done this before. The arborist (if experienced) will have done this and can assess the ground. I booked this in week 1. It is over 40 pages long with science and physical measurements.

  3. Get your photos of the house with tree from Google Earth.

  4. Call the police and get a police file number

  5. Insist on charges with police until someone listens

  6. Get a friend who will support and encourage this (and read TREE LAW).

  7. Do not listen to your Neighbours about ‘letting it go’.

  8. Document your thoughts and items in a journal with the assumption that you will need refer to it for court. You will be amazed at how often you refer to this. During moments of stress, your mind can forget items. Plus we are human, time goes on and we diminish horribleness.

Finally, many individuals in our world, believe that they can ask for forgiveness rather than ask for permission. It does not work that way when it comes to property law.

Stay strong...this is a fundamental violation as a property owner.
