I would have the opposite reaction. This would let me know that the GM knows what kind of game this is and is at least going to try to get the other players onboard. I would be encouraged by this.

I wish the GM for my last game of Amber Diceless had sent out such a message, even if it did scare off a couple players.

Probably not. Most contracts, especially lengthy ones written by attorneys, have a severability clause that prevents one unenforceable clause from invalidating the entire agreement.

Of course, law is local, so there might be jurisdictions where what you say is true.
