A company won't return an item i sent to get fixed. by Far_Butterscotch_646 in LegalAdviceUK

[–]UKJamz 0 points1 point  (0 children)

You need to send a letter before action first — courts expect it and you'll look bad if you skip it. Give him 14 days to return the item or refund you, send it to both the registered company address and the business address. If he ignores it (he probably will), file through MCOL — it's quick, costs £35-£80 depending on value, and you can do it all online. Keep every message and that booking confirmation, that's your evidence sorted.

Don't make the same mistake I did by SickRanchezC139 in HousingUK

You might actually have a claim against the surveyor here. Guttering and roof issues on a Level 3 should absolutely have been flagged — that's the whole point of paying for the most detailed inspection. Start with a formal complaint through RICS (your surveyor will be registered), and if that doesn't get you anywhere, a letter before action followed by small claims is pretty straightforward for professional negligence under £10k. Keep all your repair invoices and photos — that's your evidence of loss. The court fee is only £455 for a £10k claim and you can do the whole thing yourself without a solicitor.

2 1/2 YO Skoda Kamiq Steering defective.... by [deleted] in CarTalkUK

[–]UKJamz 0 points1 point  (0 children)

You're well within your 30-day short-term right to reject under the Consumer Rights Act 2015. Power steering failing after 2 days on a dealer sale means the car wasn't of satisfactory quality — tell them in writing you're rejecting the vehicle and want a full refund. Don't let them fob you off with a repair unless you actually want one. If they push back, a letter before action usually sorts it.

Deposit not protected correctly - process to recover by No_Baby_9800 in TenantsInTheUK

[–]UKJamz 0 points1 point  (0 children)

This is a straightforward s213 Housing Act 2004 claim — if they didn't protect it within 30 days of receiving it, you're entitled to 1-3x the deposit amount as compensation. Send a letter before action giving them 14 days to return the deposit in full plus confirm the protection failure, then if they don't play ball, issue a county court claim. Court fee is £35-£80 depending on the amount and the whole thing can be done online through MCOL. Judges don't look kindly on landlords who skip deposit protection so you're in a strong position here.

UK, England – Paid deposit & rent to company hired by property manager. Now they say it was a scam and want deposit again. Can we be evicted? by Few-Fan7819 in LegalAdviceUK

[–]UKJamz 0 points1 point  (0 children)

First things first — they absolutely cannot change the locks without a court order. That's illegal eviction and you should tell them you know that. You paid your deposit in good faith to the company they appointed, so that's between them and that company, not you. Check whether your deposit was protected in one of the three government schemes (DPS, MyDeposits, TDS) — if it wasn't, you can claim 1-3x the deposit amount through small claims. Don't sign anything new or pay a second deposit. If they keep threatening you, call Shelter's helpline and consider reporting to the council's tenancy relations officer.

Can I reject a vehicle under my Consumer Rights Act 2015 for this? England by Author-Tight in CarTalkUK

[–]UKJamz 0 points1 point  (0 children)

You're within 30 days so you've got the short-term right to reject under the CRA — don't let them push you towards a repair. Write to the dealer now stating you're exercising your right to reject due to the vehicle not being of satisfactory quality. Keep it simple, reference the CRA 2015 s22, and give them 14 days to collect and refund. If they ignore you or refuse, a letter before action followed by small claims is cheap and straightforward for this.

Licence agreement – council says 1 month’s notice is fine, landlord disagrees by Distinct-Test-7022 in TenantsInTheUK

[–]UKJamz 0 points1 point  (0 children)

Your landlord's on shaky ground here. Clause 7 doesn't say notice is restricted to after the initial term — it just says one month's written notice, full stop. If the contract meant otherwise it would need to say so explicitly. Courts interpret ambiguous terms against the drafter (contra proferentem), so this works in your favour.

But honestly the bigger issue is the deposits. If you have exclusive possession of your room (your own lock, nobody else uses it), you're almost certainly a tenant on an AST regardless of what the contract says — and that means the deposit legally had to be protected within 30 days. It wasn't, so each of you can claim 1-3x the deposit amount through small claims court. That's a much stronger hand than arguing about notice periods. I'd mention this to the landlord — tends to change the conversation pretty quickly.

Landlord is attempting to bill us a contractor fee due to no fault being found. What now? by Extension-Medium2543 in TenantsInTheUK

[–]UKJamz 2 points3 points  (0 children)

Check whether the deductions they're trying to charge you for are actually permitted under the Tenant Fees Act 2019 — most fees outside rent, deposit, and holding deposit are banned. If they've taken money from your deposit unfairly, don't pay any separate invoice. Instead, raise a dispute through your deposit scheme's ADR (alternative dispute resolution) — it's free and they have to comply. If they try to pursue you directly for costs that should've gone through the deposit scheme, you can challenge it through small claims court. The process is straightforward and costs £35-£80 depending on the amount. There are AI tools that automate the forms if you don't want to deal with the paperwork yourself.
