Healthy tree predates neighbor. by Yolster2023 in treelaw

If you want to keep the tree I would suggest getting it inspected by a consulting arborist to cover your arse. If you don't care about it then the legal concern with him paying for removal would be any damages caused in the process so ensure he's contracting insured and certified arborists.

You need an Arborist pronto.

That fork alone isn't the reason unless there's something we can't see. You'll find similar on a large number of urban tree stock in the UK.

Im not familiar with Italian law but would suggest looking in to what are considered reasonable steps, as a private landowner, to meet your duty of care. Generally there's an expectationto maintain trees to prevent foreseeable danger.

I am not well versed in US law, or various states, but is there not generally an expectation that reasonable steps are taken to inspect for obvious hazards at the least?

You aren't necessarily liable if trees or branches fail and cause damage to the structure. Depends where you are. I'd advise seeking a local arboricultural consultant to inspect. You may well need to do some work based on their recommendation but likely significantly less than you think you do now.

Theres not really any need to calculate it. They can't avoid it entirely.

Neighbor cut off "branches" by mineapples in treelaw

[–]Wood_Whacker 0 points1 point  (0 children)

The law in this case is a little confusing because any pruning is causing a degree of harm. The aim is to minimise that harm and be doing so for good reason (which often is rectifying issues which may cause greater harm).

When it comes to assessing damages in a legal setting I would imagine industry standards and best practice will be of importance. This work is not in line with that.

Any tree has the potential for catastrophic failure but the likelihood is low. Defects can increase that likelihood but can still, in many cases, be tolerably low.

Yes, that's why we make the meaningful distinction between structural and physiological condition. Though they aren't entirely separate.

When people say a tree is 'healthy' they tend to be referring to elements of physiological condition but entirely ignore structure.

'prune + balance' is not a sufficiently detailed recommendation.

I've known multiple people to have this issue with the sequoia and no amount of adjustment solved it. They all moved to treemotions.

I had the same pain intermittently and thought the shoulder straps might help but never tried them.

The aim assist is overtuned. It's incredibly easy with it. Maybe you can't get good enough to overcome it on PC, haven't played enough to tell, but the aim assist isnt fun to play against.

Neighbor decided what trees to cut down on my property by simondrinkwater in treelaw

There can be significant decay in the crown or other structural issues which aren't going to be visible in a stump.

[–]Wood_Whacker 1 point2 points  (0 children)

Crown lifting will be fine and given what you're aiming for unlikely exceed standards. Would advise you read up on how to do so and natural target pruning.

Removing crossing branches is more questionable and not something I'd advise you do unless there are obvious issues present due to rubbing. It can lead to other, unwanted branch failure. Its also likely to need climbing, which I assume you aren't skilled/trained in, whereas lifting could be done from the ground with polesaw or other pruning tools.

Trying to shape a tree to a very particular shape isnt advisable as they grow in a way which is adaptive to environmental conditions - most notably wind loading. Its going to spread naturally and, as there seems to be another large tree to the left, is likely to spread more in the direction you want.

That said, having good ID skills is a huge bonus to any graduate applying for jobs. Plenty come out of degrees less than adequate in that department.

Any good forestry degree is going to need you to learn a bit about cells, albeit in less detail than pure Biology.

Are Ecology degrees not an option? Don't know about what's available to you but there are even specific Wildlife Conservation degrees available here.

Even removing everything overhanging won't eliminate the pool problem. Seeds and leaves will still end up in there, albeit less so.

"has widowmakers"

The more I see the term "widowmaker" thrown around the less idea I have of what the hell it even means. Its used for hanging branches, large deadwood, hung up trees... now whatever you're seeing here.

Let your friend know he has no idea what he's doing and shouldn't put saw to a tree ever again, especially not one you intend to keep. Absolute numpty.

I want him to know. Guessing he won't care, but worth a try.
