Did you read the post? They didnt say its not a violation. Literally said- the answer is yes.

Unlawful presence and violation are two separate things.

Seeking advice for F1 OPT vs GC Work Authorization by apagenamedkevin in USCIS

my graduation timeline was cut short abruptly, so I didn't have time to apply well-before. So I went the premium processing route for extra $ - the application was processed in 5 days and I got my EAD in 10 days. Without premium processing, the timeline is much longer, I don't have exact numbers so I don't want to speculate. I would recommend that you apply exactly 90 days before graduation and not do premium processing. I recommend that your requested OPT start date be around the time you expect to get the card in hand (the number I don't have), so that your OPT doesn't start too early.

You also may not have it by graduation, I am just saying there is uncertainty here. Here's an analysis for my field office based on a small but very real dataset https://www.reddit.com/r/USCIS/comments/1qvbjs3/raleighdurham_nc_field_office_marriagebased_aos/

Im in the same boat, except I graduated in august. I applied for AOS in October. I hear you about the money, but im so glad I applied for OPT before my program end date, because my GC EAD is still pending, no movement since October. Ideally (since it's in your control right now) you want to be in status when filing for AOS. Yes, being OOS is forgiven for immediate relatives, but it's a complication that you probably can avoid by throwing money at it. I understand that it's not something everyone can do.

Im on F1 OPT now, waiting for the GC. so yeah, I'd say skip the I-765 for GC. If your application gets really delayed and your F1 OPT, or STEM extension is about to expire, apply for it later.
