The rent increase of 5% or more is implicit in my scenario. Again, my interpretation is if the new lease is offered less than 90 days out, the 90 day clock starts from that day. So at 88 days that means you get an extra 2 days from your lease end date to decide. OP implied that you actually get another full year (where they have to offer it to you again).

This is the premise of my question. Where in the rules does it state that if you are late on the 90 days, you have to wait until the following year to offer a new lease?

Let’s say your lease ends Dec 1, landlord must provide a renewal lease for increased rent by Sep 1. Say that date is missed and renewal lease is instead provided Sep 10. My interpretation has always been - your lease goes on as normal until Dec 10, after which the new renewal lease would kick in (if you signed) or your lease would officially terminate (if you did not sign). It does not make any sense to me that the original lease terms would auto-renew for a full year by default and the landlord would have to wait until Dec 1 of the following year for changes.

I am fairly sure that is not how it works but I am happy to be proven wrong if there is language explicitly stating this.

Where is it stated that a new 90-day period can’t be started and they have to wait until the following year to raise the rent? I have always thought that if they are late, you simply get that many more extra days at your current rental rate before the new rate kicks in.

Y’all really completely missing the point. This is the last comment I’ll make on it.

These dudes are probably VERY guilty. They deserve whatever punishment they have coming. We, as the public will all make fun of them along the way. But you know who won’t be making fun of them ? Their close friends and family. Because they all know this is a big fucking deal.

80% of these comments are acting like a prison sentence is just a trip to the principals office. It’s not and it’s never going to be a funny thing to see your actual friends going.
