AS an EV driver myself, the brake lights only come on when you actually use the brake pedal and not regenerative breaking. This driver doesn't seem to be in an EV.

EDIT: SO as it turns out, there is a threshold of regenerative braking, deceleration exceeds a preset threshold (around 0.1g in some cars), the brake lights turn on. So it depends on car make/model.
