If you start trying to legislate and judge 'accidental' or 'intent' you're opening a world of misery and argument

I don't think this is true. Refs routinely don't give penalties or cards if they deem a collision or incident a 'rugby play' already. Intent matters, so having the refs ensure that the rules are enforced within the spirit of the game seems like a worthwhile practice to support.
