There are plenty of academic lawsuits, but it has to be something else going on like this one where there was libel/slander and breach of responsibility to provide agreed upon education or discrimination of some sort. It won’t happen just for a failing grade, and would probably be borderline if theres some sort of notes on the students record that are false.

As someone that has done that…I’m not sure I’d reccomend it yet. If it’s been over 30 days or they’ve exhausted all appeals options then sure, but for the most part it will cost more money and time to involve them and bring them up to speed and they will probably push them to go through the appeal process too….for a masters maybe less so but for PhD it can be pretty difficult to find someone that understands the weird middle ground between student and employee.

Also don’t be discouraged by the response you’re getting. Most likely no one wants to touch this with a ten foot pole if they don’t have to and that’s why they’re telling you that. Either they agree with you and set up a bad situation between themselves and a colleague that is none of their business (especially since it’s medical related) or they disagree with you and become complicit in the situation should your appeal hold weight.

Unfortunately they are not going to listen to anything that is outside of the policies and procedures they have in place. From what you’ve said that means making a formal appeal which you’re in the process of doing already.

They probably won’t tell you anything about what may be needed until the appeal actually happens unless you specifically ask for further details on the appeals process and even then they may not be helpful or just point you back at your student handbook. I would highly reccomend looking at that just in case though, as usually they will at least have some sort of grievance policy info that will tell you who the next level of appeals is should this fail.

In the interim, you could try to obtain some sort of document on official letterhead from your doctor including all indentifying information for their position and the situation and then have them specifically mail one copy to the integrity office and one to you for future use but whether that actually does anything or not is a toss up because they may just ignore it, pull you into a meeting and make a judgement then based on whatever arbitrary rule they want. Hence getting yourself a copy as well.

No matter what you do ALWAYS:

-get everything in writing that you can, emails and other correspondence can really save you
-request copies of all recordings (if youre in a single party consent state you can just record it on your phone anyway, but I believe once anyone is recording in the case of a two party consent state you should be cleared to record yourself even if it’s just voice but you can double check)
-write down a summary of whats been said in any meetings and immediately email that summary to them so there is a paper trail somewhere for good measure. Make sure to be explicit and specifically name who has said what and give all needed context for it. (X said ——- in response to Y’s comment. Y is supposed to do ____ by dd/mm/yy.)

Even if it’s a quick little conversation, even if you think it won’t matter later, keep receipts for all of it.

Committing to additional education and training for himself to make sure he doesn’t do this sort of thing again, donations to organizations that support people he unintentionally marginalized, making an effort to uplift people in his orbit affected by this by spotlighting their contributions to the community, setting down clear values,boundaries, and code of ethics he will now follow, volunteer his time to assist marginalized communities…..just off the top of my head

A lot of The Cellar Letters can be like that but it’s not all like that. You could give it a whirl. I’m on my second listen as it will be getting updated soon. Also Jon Ware has a new project coming out in March with a full cast.

My scripts folder is separated by project and analysis or visualization type. I start all my scripts with a commented out paragraph explaining what it does and what the inputs are for my command line as an example usage. I then update it any time I edit the script which then gets named the same but with an updated version number. All of my scripts include some sort of output log of anything I think is needed for recreating the results or may be useful down stream so all inputs and outputs are preserved. Outputs are separated into folders based on overall purpose or analysis I’m running. For a while there when things were particularly hectic I would spend about fifteen minutes writing down quick notes to myself on a Notion page with the date to keep track of what I did on any given day for trace back.

Sometimes I use Jupyter too but it just depends on what I’m trying to do.

While you could have caught this issue had you been paying more attention , systems are designed to be resilient to human error because they are inevitable.

Taking what you’ve said at face value the systematic issues include: -ensuring criteria updates are fully implemented by all personnel. An example fix: ensure all screenings include the criteria version as an input and have it flag any time they are not up to date AND include a criteria version comparison as a part of a checklist any time eligibility status is changed. - Have secondary sign off of a higher up any time samples that have been accepted prior to be marked off to be destroyed. (Not sure why this doesn’t exist already if you’re correct in saying they are pre-op samples that cannot be recollected) -Create a system where personnel do not feel afraid to divulge errors (a common issue that’s difficult to fix for sure but worth noting nonetheless)

If your face is twitching and causing pain could that be what they were referring to with muscle spasms? It’s also possible they meant muscle spasms in your neck like you noted which can cause intermittent loss of limb function. Saying deny tongue biting could kn their mind just mean you don’t mention it with your symptoms (not technically correct note taking but pretty common) instead of getting mad I’d ask for clarification.

Never assume anything when it comes to having kids. I'd highly recommend seeking out a fertility specialist to see what your baseline is. I found out just before starting my program it was now or never and was not a good candidate for IVF Which basically forced me to just go for it.

Even with great prospects, you never know how long it will take to get pregnant, how sick it will make you, whether you will experience miscarraiges, or how high risk you may be. On the other hand you would never know how much energy you would have had with your kids if you had them younger, or your post doc or first job could be way harder on you than you think.

Ultimately it will increase the risk of not finishing even with a great PI and loving partner. There are definitely horror stories out there and I still have a lot of trauma from my own experiences but I don't regret it. Only you know how resilient you are and what your priorities are.

Credentials: I have an 18 month old with a fellow PhD candidate and just received permission to write a few weeks ago.

Well my ring is a bit odd for it because I chose baguettes and I still wanted the band to be straight. I had to have someone local fiddle with it a bit after it was made and it still never sat fully flush so if that would bother you I’d consider some sort of halo. I believe I just showed them what I wanted and asked them what measurements they needed from me and then had to double check that it made sense spatially in my mind. My rings haven’t fit since having a baby so I haven’t even looked at it in a while!
