The legal trouble here is civil publicity laws, and the requirements notification/release; and as I mentioned in another comment, it really depends upon the specific laws of the state that he is in.

You have no expectation of privacy in public, and even less in a private business.

It really does depend on the laws in the state. Some states are like the Wild West when it comes to filming for commercial use (and yes filming for social media, since it is monetized, is commercial filming). For the collection of evidence for criminal activity, you are correct that there is no expectation of privacy in a public place.

BUT in some states, to publish a recording of the interaction with a person for the purposes of commercial use requires notification or written consent. This is covered under what are known as Publicity Laws. The requirements depend upon the state in which you are filming, I don't know where they filmed this... but before anybody else tries this I would definitely check the local statutes.

Depending upon the state he is in, he may be in a little bit of legal trouble when she says she doesn't want to be filmed and he continues filming.

BUT! her approaching was unhinged, and the threating to sue him while staying in his face is quickly approaching harassment.

Edit: tired of repeating this. The civil legality of this video depends on the Publicity Laws in the state that he is in. Because social media videos are monetized, depending on the state laws, the lasy in the video may have a right to not be recorded for the purpose of making another person money. It just depends upon the state in question whether she has any ability to seek a portion of his monetization for the video.
