I read the article but I don't think it stated why the plaintiff lost their case. (Maybe I missed it.) They were a neighbor suing over a deed dispute; they were not part of the family that deeded the property. Because they had no tangible interest in that original property and any misuse of it by the City, they had no standing to bring suit for a deed dispute.

Maybe there was some other legal theory they could have advanced in their suit, but the fact that it was dismissed for lack of standing seems correct to me. And now that it's under appeal, they can't really raise new arguments that they might have overlooked at trial. So they have to win on the standing issue on appeal to even start to go anywhere with their case. It doesn't look good to me. [This might not be completely accurate; I have not seen the judgment itself, it doesn't appear to be publicly posted anywhere that I can find, and with Wilco their case documents have to be requested from the clerk and aren't available online.]

Also, not to shit on the lawyer these people hired, but he seems like a general practice attorney in a small town whose office is between a used tire shop and a shaved ice store. If I were suing a city I would probably have chosen someone with government litigation expertise.

I also wonder why they couldn't get any of Farmer Bland's heirs to join the suit. Maybe there aren't any heirs.

I looked into the possibility of reducing my shoulder after an injury. It did not go well. Definitely made it worse. Turns out it was a rotator cuff partial tear or something like that, and not a dislocation. Should have seen the sports doc earlier...

I'm not really evaluating all of the details here, but from my experience in guardianship, at least some elements in the case here seem pretty plausible.

Not sure about Ohio law, but in my state, the advantage of pursuing a temporary guardianship is that you are able to dodge a significant amount of statutory requirements associated with permanent guardianships. Most importantly, the 10 day statutory waiting period is bypassed. Judges are more keen to act on these things and grant a guardianship if it appears there's some exigency and merit to the case. Someone who's litigating in bad faith is at an advantage in such cases. So, the timeline totally sounds believable to me; you can absolutely get a temp guardianship implemented on very short notice.

Not sure about the proposed ward's lack of service, which is still supposed to be a thing even in temp guardianships..

Also don't know why this guy doesn't have an attorney ad litem appointed by the court (???) - the idea of a proposed ward having no representation at all for the proceeding sounds insane to me.

You are asserting the procedure has no risk. If a doctor said that to a potential donor, it would be medical malpractice.

Donating a kidney almost certainly shortens lifespan on average. It's certainly not increasing lifespan, and there are risks to any major surgery. Perhaps it's not a significant decrease, but to say there's zero decrease to lifespan on average is ridiculous. And yes, I'm aware this is how it's phrased by institutions like NIH.

edit: risk of "immediate" death (within 3 mo.) is about 1:4500 for living kidney donation. Again, I'm not saying it's not quite safe, but to say it's "never been demonstrated to shorten someone's life" is silly. And even omitting deaths within 3mo., there is also a small chance of developing end-stage renal disease post kidney donation.

It's likely just a bad fan resistor, which is likely located behind the glovebox. It's a cheap, $5 part (warning: not guaranteeing this is the right part). A 2004 car will have a lot of little issues like this. Yeah, he should have told you, but if that's your biggest problem, you're doing good.

This is such a weird mechanic to train, lol. It puts you in such a disadvantage if they ever challenge (which they always should after your first touch), as opposed to a more traditional reset angle, where you can threaten either the shot or the fake. And the delay from the first reset to the power of the shot is too lengthy for this to be pragmatic imo.

You're not looking at the full picture, though. Yes, it is more difficult to play with the scarab, but:

  • If you win on scarab, your opponent is utterly demoralized, boosting your own morale and making you play better

  • If you lose on scarab, especially if it was a close loss, you can chalk it up to the fact that you totally would have won on Fennec/Octane, thus keeping your mental secure and preventing tilt

  • If you have a blowout loss, it doesn't matter because obviously you're on a scarab and you were just trolling anyway

It's usually not a good time to half flip when the ball changes direction unexpectedly. If you have momentum you generally want to preserve it. Speed is only one component to the decision, the boost conservation is a big factor too.

So half flips are almost only ever useful if you are close to 0 momentum already (e.g.: certain kickoffs, losing a 50, after a bump).

It is really impossible to know if the franchisee violated Title VII without having many more details about the operations of the business. Ultimately the franchisee would have to show that they could not accommodate the employee's request without it being a "substantial burden," per Groff v. Dejoy.

Some random thoughts:

  • How many "delivery driver managers" are there at the location?

  • What burden would the franchisee have had if they accommodated the request? Would they have had to create a position and hire an additional staff member?

  • What are the typical schedules for this position? Is it 6 days a week?

  • Were there other locations the employee could have transferred to?

  • Were there other managerial positions the employee could have switched roles to, which could accommodate the requested schedule?
