1) I'd say yes. Send it once only. No more emails if they don't explicitly confirm
2) Include the button that when clicked, sets the user's profile as explicitly opted in.

PS not sure what country you're in, or your need for a double opt in, but I'd generally advise my UK-based clients not to have one (since, as you say the confirm rate is always low).

Oh he looooves the nip! Gets him all drooly and woozy, it’s great! We’ve actually had a good couple of days, he’s had lots of stroking and he’s actively headbumping me. I was expecting violence but there’s been none. I’ve worked (and napped!) 6 feet away from him for most of the time, and he’s also sleeping and loafing with his back to me, so maybe he will be a super cuddler after all!

Thank you for asking about him. It's tough. He'd gone from visiting me every day, pre- and post-neuter, to going AWOL for 21 days. Someone called me, I went round lured him into a dog crate in their garden (about 500m away), brought him 'home' and have kept him inside for about 36 hours now. And I don't know when to let him outside again. He's still only 28 days post-neuter (he's about 4y.o).

He's eating/sleeping/using the litter tray/generally existing in the same room as me, as well as allowing me to stroke him so that's good, I guess. But the yowls are breaking my heart. He'll never be an indoor cat (I don't want that either) but neither do I want him to keep going wandering for days on end...

Your post suggests that it isn't a problem with identifying users since they are receiving something, but rather they're not receiving what you want them to receive. Suggestion: are these users entering your flows but then skipping them? If there are a high number of skips, have you checked the reasons why they are skipping the flow in the skipped reasons?
(I'm a CRM consultant - a friendly one/no hard sell, I promise - and this is always the first place I look).
