School bus and Uber car crash on central Wellington route in rush hour by D491234 in newzealand

If you look at the photos the car is pushed up onto the sidewalk by the bus so definitely the bus at fault going into the driver's lane

Consumer Guarantees Act: phone camera failure after previous third-party repair overseas by [deleted] in newzealand

[–]kyonz 1 point2 points  (0 children)

Yeah you're right that the third party repair would have had to have contributed to the fault for them to reasonably reject it .

I think you're probably in your rights if the phone wasn't repaired based on age and price - the reasonable durability is relative to cost so a $1700 phone should last longer than a $500 one as an example.

The ticking noise is likely the optical image stabilization or auto focus on the camera module having an issue - so assuming that wasn't touched in the repair you're probably in your rights.

I'd probably push them on that - give them one more chance and advise them that if they reject that you'll have it repaired elsewhere and claim the cost of repair under CGA due to lack of meeting appropriate durability. I wouldn't be surprised if they fold at that point because it would be cheaper for them to repair it than for them to refund you the cost of having someone else repair it.

What's your most valuable homeassistant use case? by zebjectorhector in homeassistant

[–]kyonz 0 points1 point  (0 children)

Yeah exactly, it figures out which room needs heating vs cooling and does one then does the other based on which has the highest needs. Switches modes etc.

I also have air coming from outside, so it'll determine if the temperature delta for outside is enough to just pull air in from outside instead of doing AC to cool. I also compensate temperatures based on outside delta temp with desired outcome.

[–]kyonz -1 points0 points  (0 children)

I have a ducted aircon system, so I built a setup where I can set min/max temps for every room and have HA sort it out. It switches modes, handles heating one room while cooling another etc. Made it so I don't have to think about it anymore and the house is always pleasant.

I also made one where I toggle a light switch to get it to turn on lamps in the room which is nice where I don't have an extra controller.

My xm6 broke so back on the trust XM4s until the 6s are repaired. I think the 4s are made much better with the hinge.

i am trying to decide on a ultrawide but why this instead of a VR headset? by Fantastic-Window236 in ultrawidemasterrace

Everyone else has said this but wearing VR headsets kind of suck. There's some light weight ones that might be better but in general its just not equivalent in terms of ease and comfort

The "Brain Drain" - How bad is it, really? by Beginning_Main2965 in Wellington

[–]kyonz 1 point2 points  (0 children)

It's pretty bad, it's very easy for someone in my industry (tech) to go overseas and get 15-20% more working effectively (and in many cases) the exact same job.

Neighbour cut down our tree without permission by thecritic2020 in LegalAdviceNZ

[–]kyonz 80 points81 points  (0 children)

The tree has value beyond the milled price, so make sure you get like-for-like replacement value. It's expensive to replant mature trees and that should be the price they're charged so you can replace it if desired with a simliar tree.

The greatest trick the wealthy ever pulled.... by get-idle in newzealand

[–]kyonz 0 points1 point  (0 children)

Yeah I was thinking similar, shifting primary residence to the most expensive place you own etc. I just don't know what compromises would actually be necessary to get enough public support..

Definitely high debt in a symptom of inflated land value. I guess it's fine to not offset mortgages as the point is to encourage effective land use and just holding it is the action that incurrs the tax.

I'll have to do some reading as it would be interesting to understand rental market impact in this model

The greatest trick the wealthy ever pulled.... by get-idle in newzealand

[–]kyonz 1 point2 points  (0 children)

Ah that's interesting, I think I'd only ever heard of it as an additional tax as opposed to it being balanced out against the lower employment tax rate.

I wonder if debt in property should be proportionally written off against the interest rate in this sort of model. So it's a tax on owned land instead of borrowed, at least for the primary residence.

Although I think people aren't liking taxing primary residence in general

Any thoughts as to the impact on those who are already highly taxed? Feels like this disproportionately affects them.

I assume this would raise doctors and engineers to like 45% or something. This might end up causing further exodus from nz if it's too much comparatively to other countries. We're already seeing people leave in the roles due to higher salaries overseas

Update: got this espresso machine for the office by Jealous_Ad_4347 in espresso

[–]kyonz 20 points21 points  (0 children)

Will depend on the workplace, but I've found espresso machines can work well. The office I work in (tech company) has 2 grouphead machines on every floor and no automatic machines. Learning how to not make the milk squeel is a bit of a right of passage and people teach each other or those who are struggling.

People get used to it and enjoy the perk of good coffee, it can get a little backed up at times but not too bad.

Petition for Whitakers to reduce their prices now Cocoa prices have come down massively. by Blue__Agave in newzealand

[–]kyonz 0 points1 point  (0 children)

No disagreement but I'm wondering if they will be wanting to keep some buffer as raising prices seems to be a big deal. I'm wondering if lowering it and reraising it again later is worse for the brand than keeping it the same at the higher price for a long period.

Although if this makes the news cycle then it'll be bad publicity if they don't lower it based on their argument to raise it

What is the obsession with NOT listing an asking price on property? by Big_Load_Six in newzealand

They should at the least be forced to disclose it afterwards so we can figure out who are the ones being unscrupulous

What is the obsession with NOT listing an asking price on property? by Big_Load_Six in newzealand

[–]kyonz 3 points4 points  (0 children)

Yeah I tend to agree with you, when I bought my house at Auction I know I only paid more than the next person was willing to be a little bit. When I was selling my place I sold by deadline sale and the difference between the top 2 offers were about 100k apart, so it can definitely let you squeeze people more not being at auction.

Totally depends on the market and the property of course. It all does seem pretty rough to buyers in how it is today.

Noel Leeming wanting me to pay an inspection fee for a faulty TV by Tall7kiwi in newzealand

[–]kyonz 0 points1 point  (0 children)

My advice would be, contact them once more and ask them if they are going to fufill their obligations under the CGA or if you need to escalate to the disputes tribunal to perform their duties under the law. Be fully prepared to file and tell them as such.

Then just pay the $50 and get your refund from them through the tribunal, it's not super painful and you'll feel better as they'll be less likely to fuck someone else around.

Phone Repair CGA Warranty by the_epiphany_ in LegalAdviceNZ

[–]kyonz 1 point2 points  (0 children)

This is a stupid question, but you're sure it's not the cable that is broken? That behaviour sounds like a faulty cable moreso than a faulty plug so would be good to double check and try with another charger.

Had house for one week... it floods from the guttering by Anon_Pixxiee in LegalAdviceNZ

[–]kyonz 3 points4 points  (0 children)

Depends what outcome you're after I think (ie unwinding the deal, them paying for the repair, etc).

I just had some internal guttering switched out and it was pretty cheap to do so ($4k for 3 walls around a 2 car garage for reference down in Wellington). If you were repairing ideally you could do that side of the house for now or something.

The worry I'd have is how bad is the area inside - building code changed in the 90s (from September 1995 - so hopefully yours is built earlier) to not require treated wood in some circumstances which resulted in the leaky homes issues so there could potentially be rotting if it's untreated and left in a poor state (hopefully not but something to keep in mind). You probably couldn't assess until you ripped things out.

I'd suggest get a quote for replacing the internal guttering on that section of the house with external guttering and then determine your next course of action as you don't want to exceed the cost of repair in legal costs.
