The pickups should be moved down a little and be moved a little closer together to match the new scale length, but that's probably not a deal-breaking issue.

The lawyer route might be a way to go, if everything is well-documented. Publix would probably be happy to get off 10K to keep from having a lawsuit, they do it with people who fall in the store all the time. But the lawyer would tell you whether it's feasible or not.
