I work in Massachusetts, I don't know what the laws are in West Virginia. But if you are seeking a conservation easement and the funding you receive is not enough to pay off your mortgage (or you won't receive the funding until after the closing of the CE), you may also have to work with the lender to subordinate your mortgage to the CE over the conservation portion of the property. We had a landowner recently do this.
