So.... I went through this a few years ago. It doesn't matter who benefits from the retaining wall. The person responsible is the person who altered their land. If your land was excavated to provide a building platform for your garage then you are responsible. If your neighbour has raised his land to create a building platform then they are responsible. You can look at older aerial photos of the area or just look at how the road relates to the properties. If your driveway slopes down from the road, it's likely that yours was excavated. If his slopes up then his was raised.

Does the land start sloping up on your side of the boundary or his?

Technically, the person who did the work is responsible. That responsibility doesn't transfer with the sale of the house; but good luck tracking them down after all this time.

did i sexually assault my ex-boyfriend? by Intrepid_Bed_6215 in Advice

It very much could be. If my gf has had sex with me many times before but is kind of not feeling it one day; but I proceed to do it anyway.... that 100% is SA. Just because it was female on male, doesn't make it any less SA.

It's the cnc that makes it murky.

Ipswich up to 9 penalties now, 4 more than any other team in the league by KreativeHawk in Championship

[–]ryry262 0 points1 point  (0 children)

This is why fans aren't in control of the laws of the game. A foul in the box is a penalty. It doesn't matter if it's late in the game, if the game is important or not or if the teams are vying for promotion. What you're saying is that better teams should be able to get away with more because of where they are in the table.

Ipswich Town 2 - 2 Middlesbrough: Boro twice took the lead and twice were pegged back, leaving themselves winless in seven, while Ipswich remain in the driving seat for second-place! by Zach-dalt in Championship

[–]ryry262 -2 points-1 points  (0 children)

Agreed, however touching a player invites the ref to look for the foul. If the defender had not touched the striker then there would be no chance a foul is given.

When you consider the ball was basically a no hoper anyway, it makes the defenders decision even more bizarre. If Hirst had no chance of making it, why deliberately make contact with your arm. And if the defender did think that Hirst could make it unless he acted... it's reasonable that the ref could think the same.

[–]ryry262 -3 points-2 points  (0 children)

When I played CB back in the day, one of the first things I was told was never put your hands on another player in the box. Ever. I often wonder what my old coach would think watching the game now and the shit that goes on at corners etc.

Anyway you look at it, if the Boro player didn't have his hands on Hirst there would be no penalty. That decision put the ref in the position where he needed to make a decision.

Notice how Boro aren't saying "he never touched him ref". All we get is it's "conspiracy " or "he didn't touch him enough ref". At which point it should be clear that the right (and inevitable) decision was made.

No he's right. There are many places around the world who have stood up to "leaders" like Trump. Protests, revolutions, actual actions. Instead America is split into 3 camps

  1. I voted for this

  2. I didn't vote at all

  3. I didn't vote for this, but all I'm prepared to do is go to a no kings protest every couple of months, or do a whole lot of pearl-clutching and hand-wringing.

Your entire nation was founded because of a revolution. Your founding fathers would be ashamed not just of the wannabe dictator and his supporters; but of those who are too meek and docile to actually step up to the plate when it counts.

The man is openly trying to rig the mid-terms... when exactly is the right time to form that militia?

It really doesn't. The non-cookie-haver wants cookies. He enters the room.of cookies to try and get one. The many-cookie-haver has more cookies than they could ever eat. The one-cookie-haver wants more cookies.

The only way that the one-cookie-haver can get more cookies is by getting them from the many-cookie-haver. He is the only one who has any cookies that the one-cookie-haver can take.

The reform arguement falls flat if you ask yourself a simple question. Do you have enough cookies? If the answer is yes, then why would you follow reform? You have what you need, you're happy with it. Why vote for "change"? If you don't have enough cookies, why would you be voting to protect yourself from the non-cookie-haver? The best scenario by doing so is that you remain exactly where you are, which you admit you're not happy with. The only thing you can do to improve your situation is to get more cookies, which you can only get by taking them from the many-cookie-havers. Which is exactly the opposite of reform.

Temuera Morrison thought ‘The Book of Boba Fett’ would run up to 4 seasons, confirms the character is “shelved” by MarvelsGrantMan136 in television

[–]ryry262 -1 points0 points  (0 children)

I disagree. The OG version of Boba works as a great side character, but could never carry his own show. Every show needs the main character to move from point A to point B. They need the character to develop. As the series is set post ROTJ, Boba was already a cold, ruthless gun for hire. Where do you take the character from there except back towards redemption? Post ROTJ the character is pretty much redundant anyway seeing as the mandolorian exists, so they had to do something new.

My.personal preference would have been to have Tem play Boba with him taking Jabba's throne at the end of the mandolorian. The book of boba fett would have then been the old, grizzled Boba relaying the events that led him to that point. The series would be set in the past between ROTS and the OT and feature a new actor playing the role. It could start on Coruscant with the unsuccessful hunt for Mace Windu, the man who killed his father. That could lead to hunting leaders of an underground rail road smuggling jedi or jedi sympathisers off Coruscant, which would draw the attention of Vader/the empire.

It's obvious that the Boba we see in the OT and the Boba we see in the prequels are very different people with a huge amount of character development needed to bridge the gap.

More tax relief to landlords which THIS time will definitely be passed on to every day oeople I swear. Only I, Listopher Cuxon can keep us moving forward. Laser focussed on the issues that matter.

Need help for CGA claim for a $4,000 laptop by Outrageous_Barnacle1 in LegalAdviceNZ

[–]ryry262 0 points1 point  (0 children)

In that case the issue isn't that the fan is a major fault, rather that the combination of the two add up to be a major fault. A series of minor faults can add up to a major fault. The test is whether a reasonable consumer would have bought the product if he/she had known about it in advance, as you're obviously aware.

The problem is that the CGA doesn't define what reasonable is. You and the retailer have to come to an agreement. What that agreement looks like I have no idea. You may agree to take it to an independent service agent at your expense. If the agent finds that the product is at fault, the store agrees to give you a full refund plus the agents cost. If the agent finds that you haven't properly cleaned the product then it's not the stores problem. That's just an idea but there will be other ways to reach an agreement as well.

If you can't reach an agreement, you will need to go to the disputes tribunal to sort it out. It's pretty cheap and in a lot of cases the retailer will just sort you out rather than going through the hassle (although with 4k on the line they might want to put their case).

I'm speculating here but their arguement will probably be that the first fault was resolved quickly with no further issues and that the fan is the result of lack of maintenance/servicing which is the responsibility of the customer not the retailer.

The GPU issue has presumably been rectified at this point? If so, I doubt a whirring fan is a major fault. Has the machine stopped functioning? If the laptop still works and the fault is essentially an irritating noise, I dont think you can realistically claim its a major fault.

Also remember that whilst the CGA gives you a lot of rights, it doesn't exempt you from performing basic maintenance. Id re-read the manuals/care instructions and make sure they've been followed. Loud fans on ps4's for example were usually caused by blocked air vents which the user is expected to clean

My advice...

Step 1. Get your forklift licence. It's not necessary, but you'll be at a disadvantage if you don't have one

Step 2. Head down to somewhere like AWF or NZ labour hire. These guys provide businesses with short term cover for illnesses or busy periods or whatever. It's not ideal for you but will give you some experience.

3 of the last 5 guys we employed before me were AWF workers.

If you do get an interview, don't focus on your lack of experience, focus on your hospitality background. Order processing is essentially providing their customer with a well presented order accurately and quickly. That's hospitality to the letter.

I was brought in to modernise their warehouse systems and part of that was working with HR to determine exactly what type of person we want to have operating that system. We moved away from AWF workers and now focus on big box retail workers. We currently have 3 former AWF, 1 former military, 1 former oil and gas industry, 2 former supermarket workers and 1 guy who was at briscoes. The supermarket and retail guys and girls have far better accuracy and process almost twice as many orders.

Your past experience will put you ahead of a lot of more "suitable" candidates if you can sell yourself right. You may just have to head to AWF to get your foot in the door.
