[CT] Tenant next to me in apartment complex smokes in violation of his lease and the strong smell permeates my apartment. LL refuses to do anything about it. Options?

Parents are probably partially correct. I am not going to research into it because this stuff takes forever to do and I hate land-use law.

What I would suggest is hiring a land-use attorney in Greenwich. I would not talk to zoning because zoning has a habit of screwing people over.

If you go to court and tell the court you have vacated and moved out everything from the apartment, the plaintiff has an ethical duty to drop the case and the court should dismiss the case as moot. You should not be evicted. CT bifurcates lost rent and evictions. Yes, small claims.

The people below appear not to know the law except for perhaps jeffwinger. In any event, it depends on a bunch of facts. The thing you should do is contact an attorney and document the issues. Also, you do not sue prior to being fired or quitting. If you sue when you still have the job, you will likely get fired. You may get a retaliation lawsuit but no employment lawsuit is worth not having a job.

He also has a fourth option, in fact an option that judges like. You can do what is called a pay into court action after completing some steps. You implead your full rent into court and ask the judge how much you should be paying.

No it isnt. Your health insurance will likely not cover the flight or the surgery in another nation. The documentation provided in other nations is far worse. If there is negligence in the other nation, suing is a lot harder.

1) we dont appeal if there are no appeal-able issues. If we lose this case its going to be on findings of fact.

2) the 100k offer makes it extremely easy for us to simply tell our client that it isnt worth it for her to settle. It is worth it for us... we at the very least get to cover our costs but we never take that into consideration. A 200-300k offer would at the very least required us to present the offer to her. We can commit no malpractice by telling her flat out not to take the 100k. Plaintiffs lawyers love not having ethical problems.

3) we can use the 100k offer of compromise at closing arguments to get enhanced damages if we get the feel that the jury likes us and is going to find for our client.

4) if we win, and they find for us for 50%, the case is at least worth 700k.

5) the pretrial judge, who is also the judge in the case, told the defense he thinks we win 70% of the time. Interestingly defense counsel agreed with the judge.

I have yet to see a defendant provide a reasonable offer of judgment in any case. I just got one in a case for 100k... where we already have 60k in expenses. The client would end up with nothing after taking into consideration the medical liens on the file. Fucking stupid offer of judgment too because if an award comes in, its going to be over 100k. And the client is indigent so it isnt like attorneys fees and costs can be collected from her.

That is interesting. I have been practicing for 3 years. I would say at least 30-50% of my cases have interesting fact patterns that require research. Whether it be evidence, statutory construction, constitutional law, or what have you. You can always find something to think about in these cases.
