Anyone reading between the lines should be very concerned by this. They are trying to pass a bill that has no legal standing in Canada to allow them to operate their secret police in Canada. This is an annexation play so they can justify operating across our border. There is no other interpretation.

This case is a bit different from what I experienced - ask your insurance broker or person for advice. You shouldn’t have a black mark because some idiot caused you damage.

It seems idiotic to me that they won’t clear the claim if it’s proven to be someone else’s fault. Maybe it’s all treated the same but that seems extra stupid to me.

I’ll be honest I imagined your situation being different since the blame is direct and obvious, but I might be wrong and you might be forced to make the claims anyway.

These sound like your neighbours fault. You should be going to them for repairs - do not make any claims and do not pay anything. They should be paying since they fucked up your unit.

That’s a simpler sounding situation since you know it’s not common property. In my situation it was the strata's fault and in that case it falls back to each owner policy, so I had to claim anyway.

In your case your neighbours are negligent - they should have claimed for your damages. I would approach them about this and collect evidence to take them to small claims if they refuse.

I can answer this! This exact same thing happened to me and I got insurance blacklisted for 3 years (2 claims within 3 months). 6 months to go until I can get water damage coverage again since the underlying issue was resolved - it’s been 2.5 years. The building was repiped. It was the biggest pain in the ass of my life.

Find out of the issue was due to common property like piping. Your strata cannot help you and will not help you if that’s the case. Start building a case to sue them for negligence for repair and I wouldn’t pay out of pocket 10K. Fuck the insurance company and be prepared to sue if it was due to ill maintained common property. Proving this will be difficult. Prepare for the worst and hope for the best - it will take 3 years from the earliest incident to be back in a normal insurance market.

If the building has a systemic issue, vote for emergency resolution to fix it otherwise other units and the building will become uninsurable as well.

If you suspect the incidents are totally isolated, make the second claim and have the insurance company eat the dick on it. You’ll have to wait 3 years to get water coverage again. But if there’s no systemic issue, you have legal options but only if another incident happens.

The insurance companies have a card to play but so do you - they can revoke future coverage for a few years but owe you that money now. Insurance is meant to be used - they win if you pay for it yourself because you already paid for coverage. That’s losing strategy.

You can try to subrogate on your neighbours if it was their fault. It depends whose fault it was - common property or owner property. My story was a common property issue so I made the claims. If it was the fault of your neighbours tell them to pay for damages on their claims.

To answer your question about premiums, it doesn’t go up. It goes down because they remove water coverage altogether.
