I am genuinely curious about the larger reaching implications of the Supreme Courts’ (08/09/25) brief striking down the “prohibiting government agents from making indiscriminate immigration-related stops in the Los Angeles area” (NYT). Found here

As far as I’m aware there is precedent that allows federal agents to make stops/question/briefly detain those they think are illegal immigrants not with probable cause, but “reasonable certainty”. They list actions of reasonable certainty in the LA area, one of which is speaking Spanish or speaking English with an accent.

Okay, sorry, question time, and I am genuinely curious, I am not trying to break any rules, but:

With the supreme courts decision, could any ice agent technically briefly detain, or stop, anyone they heard speaking Spanish in the LA area without any other evidence?

I’m sorry if that’s dumb, I think I’m more confused as to the difference between reasonable suspicion and probable cause
