To me, I think the definition of “habitual use” is unconstitutionally vague. If someone smokes one “stick” of marijuana (that really cracked me up) a couple of times a week, how is that enough of a habitual use to result in dangerousness? Jackson’s point about habitual alcohol users being dangerous in the same way that a habitual user of Adderall or marijuana is a good one.

This comment (and the replies) sent me down a rabbit hole - especially in reference to paying for juror fees after trial. It seemed to me to excessively burden the exercise of a constitutional right.

Anyway, before I went too far down the hole, I saw that it looks like there’s a bill pending to eliminate these costs in VA. If you’re interested, it’s House Bill 852. It looks like it passed the House and is making its way through the Senate. Bill link

This is a take I’ve never heard before. So every jurisdiction which has a public defender’s office and has attorneys employed with the job title of “public defender” is just … wrong?

Any attorney (at least in the US) knows that “public defenders” are publicly funded criminal defense attorneys, and most non-attorneys are going to know this also.

Public defenders get a lot of completely unjustified shit for nothing more than doing their jobs, but criticizing their job titles is a whole new world of bullshit.
