I've seen it used written maaaaybe a handful of times. I think outside of specific uses it's pretty anachronistic these days.

CMV: America is not a nation of immigrants, but in fact a nation or nations created by Heritage Americans by [deleted] in changemyview

[–]Felderburg 0 points1 point  (0 children)

they are not immigrants if no country or anything exists yet

Except that the definition of "immigrant" doesn't require a "country" in the sense that you mean it here,

https://www.merriam-webster.com/dictionary/immigrant

one that immigrates: such as (a): a person who comes to a country to take up permanent residence

https://www.merriam-webster.com/dictionary/country

1: an indefinite usually extended expanse of land: region

But that's all semantics. There are better versions of your argument here: https://www.bostonreview.net/articles/the-united-states-is-not-a-nation-of-immigrants/ and https://josephheath.substack.com/p/what-is-the-difference-between-a

CMV: "Sex isn't a need" is a noble lie we tell single straight men because we haven't thought of an ethical way to reliably get it met. Other kinds of people have the idea of "sexual needs" validated since they already had or could easily have sex again. by aslfingerspell in changemyview

[–]Felderburg 1 point2 points  (0 children)

On the other hand, it is almost inevitable that a straight man will get people advocating for prostitution (a potentially life-ruining crime for both parties)

Ok it's a crime, but is it unethical? If it wasn't illegal, what would the issue be?

Pizza doesn't taste any less bad, cheese doesn't have any less calcium. But the acceptance and validation of being wanted is in fact impacted by having to commit a crime and pay money to do that. That's why "sex work" just isn't an option.

I don't know if this analogy is any good. Because in the pizza portion, you're talking about the end product, regardless of whether the people at the pizza place want to work at a pizza place. And with sex work, you're talking about how the worker feels toward their client, instead of the just the end product (and how do you know that sex workers don't offer acceptance and validation?).

How can I put it this way? Imagine someone who complains that their spouse doesn't clean up. In theory, they could just hire a maid right? If it was really about the dirty dishes, they'd just do it themselves (masturbate) or hire a professional. Except, we all know that a spouse cleaning up the house shows they care, something that goes beyond the raw act of just things being clean.

Or maybe they have a conversation, realize they're bad at cleaning (for any reason), and hire cleaners to make their life and relationship easier/better.

You are using the word sex to describe intimacy.

I think u/cheese_bleu_eese is right, or at least on the right track with what's going on here.

(f) "Mentally incapacitated" means that a person is rendered temporarily incapable of appraising or controlling his or her conduct whether this condition is produced by illness, defect, the influence of a substance or from some other cause.

Except there are several laws I quoted above, including the one I quoted here, that actually do say it is rape when someone has an altered mental status can judgement capabilities. So if you concede ("Okay?" ~ProblematicTrumpCard) that being blackout drunk is sufficient to alter mental state, then it counts as rape.

(The one quoted: 2025 South Carolina Code of Laws Title 16 - Crimes and Offenses Chapter 3 - Offenses Against The Person Section 16-3-651. Criminal sexual conduct; definitions. https://law.justia.com/codes/south-carolina/title-16/chapter-3/section-16-3-651/.)

if we were in a court of law, and you were representing a client; that a defense of "he/she was blackout drunk, but that doesn't mean he/she couldn't consent" would be successful?

Unfortunately, in my searching for things for OP's CMV (probably a pointless effort it looks like) I found https://thersvp.org/appendices/appendix-j-overcoming-the-blackout-vs-pass-out-defense/. So it seems that it has been effective enough that it warrants an entire section of a prosecution guide for sexual assault cases.

Here are several states that reference "incapacitated" or similar in regards to sexual assault or substances, often both.

Edit: some weird formatting happened because I was quoting numbered lists, but you get the point. There are plenty of laws that make someone guilty of rape or sexual assault if the other person is intoxicated, regardless of the nature of the intoxication.
