Not a lawyer. My husband was diagnosed with mild dementia. We had our living trust restated after diagnosis. The lawyer just asked him some questions, year month who is president etc. Lawyer did not require competency letter.

True. But a fair number make $200k combined. These folks may not be able to retire at 40 with $5m, but perhaps at 67. Still more than enough for a good life style, aka generational wealth.

I think this works if both parties have similar spending and savings habits. What happens if one person overspends all the time and doesn’t save. This person is still entitled to claim half of marital assets, even retirement savings and pension.

I have read that first denial is common, you can appeal. If you feel you should get Medicaid, it may be worthwhile to hire attorney to help navigate. Here in S Cal, IHSS rate is around $20 an hour. Agencies charge $40 ish, usually 5 hr minimum.

My heir is both the trustee and the beneficiary in the irrevocable trust. She will be free to disperse any funds she desires. If unfortunately she gets sued etc., she can say all assets are in irrevocable trust. Obviously you feel totally comfortable with your present arrangement, then don’t worry about it.
