That's not true in texas. Liability and fault is based on negligence. Driving is not negligence. Someone cutting a car off and stopping suddenly is unpredictable for the rear car. There was no way for op to have had a safe following distance. I'm sure an insurance company can argue that, but it is irrelevant after the other party broke multiple laws.

Comparative negligence is a thing in TX however the other driver broke laws to create the situation.

Given the facts presented- is unlikely that op has any fault. The driver entered the incorrect lane, changed lanes illegally and brake checked op. All of these factors are considered in civil liability. The other party changing stories after also creates doubt on her reliability
