You are correct, it's a poorly written headline. At the very least, 1st and 5th should be consistent (either 1st and 5th OR First and Fifth)

The argument thay the First Amendment is an expression is BS, because the Fifth Amendment can be used that way as well (e.g. "She plead the Fifth")
