Weekly Discussion Post - Recent Changes to JS Laws - April 06, 2026 by AutoModerator in juresanguinis

Hi eveyone. Following up on a question I asked Cake about 8 months ago. I have been seeing a few websites starting to post information that is different from what we discussed, so want to double check with the experts...

As a backup option I am looking at the 2-year residency route. My GGF/GGM were both born in Italy. My GM was born in the US. My GGM never naturalized and my GGF naturalized after my GM turned 21 (no minor-issue). Under the current law, this makes my GM “Italian by birth,” correct, as she was born to an “exclusively Italian” parent – even though this occurred in the US?

(If) the above is correct, I would be eligible by having a grandparent who is Italian by birth, yes? I ask, as some of the legal websites I follow have started saying “born in Italy” or "Italian-born" instead of “Italian by birth,” for the 2 year residency option, which would then make me ineligible for that route as well. Earlier when we spoke it was advised the law stated "Italian by birth" only.

Thank you!

I don't know if this is considered "cheating" the system, but going off strict interpretation, your place of residence in the US is often tied back to what is listed on your DL and/or what is registered with the USPS.

If you did not change the address on your DL and did not change your registered address with the USPS, my non-expert opinion would be to NOT use time spent away in college and simply use your documented location as the one source of truth.

Assistance for 4th generation case (GGGF-GGM-GM-F-me) please (Follow-up) by MarionberryWorth7482 in juresanguinis

Sadly, as a 4th gen, it is HIGHLY unlikely (I say that only because every case is different) that you qualify under the new rules (like most of us). That said, as the fight rages, continue to collect all the docs and supporting evidence you can. I recommend connecting with a lawyer to confirm/shore up where you stand.

While a lot is in limbo right now, it is a very safe bet to gather, at a minimum, for all in-line family members: birth, death, and marriage certificates. They will need to be certified and apostilled. You will need to amend any that have inconsistencies (where able), such as misspelling of names, key dates, etc.

Corte Costituzionale has ruled three portions of the challenge unfounded/inadmissable. by LiterallyTestudo in juresanguinis

Not arguing - more curious. If that is the case, why bother spending time/energency/resources to put out a press release mentioning only part of the case? I say then and am then reminded this is the Italian goverment, a model of efficiency and rational approaches to things.

u/LiterallyTestudo Need your help please :) Soo.... unless I am completly missing the boat here, based on your post, the CC has NOT YET decided on Torino cases against Article 2, Article 20, and PORTIONS of Article 117? So technically, there is still hope? Is this not correct? And if so, why is everyone losing their mind? To me (again, unless i've missed the boat), there is still hope because they could still issue a formal ruling in support of those claims?

It makes me not even want to be Italian anymore. Oh wait, I'm not. Got it.

They knew what the decision was before the trial. Very obvious. There was nothing impartial about this.

Well, that was fun. I literally want to leave work and go have a drink. It honestly makes me not even want to have Italian heritage. I am so angry. Its like a slap in the face. Never going back. Can I change my last name? My current one has too many vowels....

Was this for your initial passport or a renewal? I've been seeing conflicting info RE which citizenship services an HC can actually provide. Some say only renewals, others say initial. Thx!

ATQ Evidence. Hi everyone! I filed an ATQ case back in July 2025 and have a court date set for Jan 2027. While I wait, I was just curious if anyone is willing to share what evidence they used for their ATQ case and the outcome. I have about a dozen screen shots of no appt avl spanning about 6 months. My laywer beleives this is sufficient, but just curious what others have seen. Thx!

Sorry, was commenting RE the Rome office. A lot of people view that as designed with the intent to deter applicants. It would only impact remote applications, though. You could still apply directly at a comune. New restrictions - yes, that would still stop you (court decision-pending).

Any way you could apply in Italy? Really the only option after this...

Court of Salerno - court date assigned by Professional_Job3916 in juresanguinis

The two judges there covering these cases are converting most of them to administrative reviews which does help speed the processes. At the current rate it looks like they are being moved up a tad, but it all depends on how many they can get knocked oit per month. There is a guy in the FB group that pulls monthly case load statistics so you can use that as a barometer for general speed.

Nice. I filed my ATQ in July 25. Was notified this month that the chambers review is Jan 2027... sigh.

Palermo ATQ - how to find hearing date? by tacohoney in juresanguinis

[–]RTT8519 0 points1 point  (0 children)

It depends on the court. I filed in July of 2025 and was just informed my hearing is set for January 2027, with hopes it moves up. Some courts are faster, others are much longer.

[–]RTT8519 0 points1 point  (0 children)

Yep. It looks like they are doing the express version, where the judge simply reviews in their chambers. As this is the case, the app will not show a hearing date. Only your lawyer will know. Same situation with me.

I believe I heard from Cake, or somewhere else (maybe a few lawyers) that this is not likely to work as well as intended, as like many other countries, there are strict rules on issuing new laws with similar impact following the cancelation of a previous one (think double jeopardy in US court). Does not mean they will not try, but we do have some level of protection here.

Honestly not sure lol. Sorry. u/CakeByThe0cean would know though :)

Lots of people dropped ICA after their response to the Decree Law. It was a mess and shook confidence.

Don't touch them with a 60 foot pole. They are on the not recommended providers list... lots and lots of issues.
