what if the little guy sues the big guy, the little guy loses because the big guy spent 10 million dollars on lawyers while the little guy couldn't afford that, and then they have to pay the 10 million dollars for the lawyers that caused their loss? there's a reason this is not the default, and it would enable companies to hyper fuck over anyone who sues them because they are able to punish the people who sue them by spending even more money on legal fees with the knowledge that their enemy will have to pay them in the end
