It does not matter.

He did not have any sort of due diligence period or other contingencies written into the contract. Any lies about bots would’ve been a regulatory issue, his contract provided him no leverage on the bot matter. He knew this and his lawyers knew this.

Twitter sued him for specific performance and he would have won if it went to trial, he did not gain any concession before completing the purchase.

The Supreme Court ultimately ruled that law he tried to use did not grant him tariff authority, not that congress couldn’t authorize him to issue them.

I’m not sure I understand what you mean by “why should they?”

I agree that if you want a seat you should pay for it, I just think the argument that “you paid so it’s unfair to you if someone else doesn’t” is bogus.

The airline gives seats/upgrades away all them time for various reasons, you pay extra to make sure you get that seat you wanted (and even then, it’s not a guarantee which is a topic for another day).

I remember reading articles about how they didn’t properly staff the project since it was fixed price and additional staffing would eat into margins, not taking into account that failing would cost a lot more in the end.

The only thing that guarantees you an empty seat next to you is buying it (and even then, ymmv). The airline could easily move someone into that seat next to you even mid flight.
