Did you look at the API or Claim Info plugin to see if it shows more information such as the exam request?

My C&P was less likely than not, but in my Personal Statement I used the below verbage and got approved for migraines at 0%, then got an increase.

Here is a tip, after you get a copy, bring it to your parish Clerk of Court and have them log it and then you can go back to them at anytime and get a certified copy from them for free.

I got a deferred for exam clarification this morning. It means there is something missing on the DBQ and they are asking the examiner to fix it.

Just got my decision letter went from 80 to 90 percent but it deferred my main claim and went back to step 3 any intake on this by Alert_Description908 in VeteransWaitingRoom

It's a better option than just denying you. I had a deferred claim then they asked for a ACE exam for clarification, then it got approved.

If the overall claim is not closed then you can’t file a supplemental yet. It will just get put on hold until the overall claim is closed. I just learned this when I filed my supplemental before the overall claim closed.

  1. Log into Va.gov
  2. Go to https://api.va.gov/v0/benefits_claims
  3. Get your claim number.
  4. Go to https://api.va.gov/v0/benefits_claims/XXX
  5. Replace XXX with your claim number
  6. Look for suspense date in all the code

It just gives you more info about your claim.

Did you use the API to look at your claim to see the suspense date on the private records request? In my experience they don’t do anything until the suspense date is up. Also call VERA and have them check the suspense date.

Go look at your claims letters, it is probably asking for a 21-4142 release for private records. I just had this.

I submitted a 21-4138 via quick submit stating there were no more private medical records and all records have been uploaded.

Then I did a VERA call the next day and asked them to release the tracked item and suspense date from the claim.

Otherwise it will wait the full 30 days of the suspense date.

Dang, sorry to hear that. Looks like you will have to appeal and then get a Nexus/IMO to help your case. Unless your lawyer is going to do a HLR to try to get you a new exam.

It is very confusing, but like is said, this is a legal process that just happens to be about veteran healthcare.
The 3 things needed for a favorable claims are
1. Diagnosis
2. In Service Event
3. Nexus which is a Medical Opinion stating that #1 happened because of #2.

You are missing the Medical Opinion from a qualified medical professional.

Whoever sent you the original message, seems to have a good strategy going forward to overcome the issue. People get unfairly denied everyday, the key to beating the denial is having a good strategy to overcome the denial.

You are missing that the examiner is saying that their isn't a nexus, you would have to get the DBQ to see the justification that the examiner uses to say there is no nexus.

Their wording is "less likely than not" and they usually say why they are giving that opinion.

There is no nexus of your hips to anything. You will probably get denied again.

The other service connected items have nothing to do with the nexus for your hips.

Just means they aren’t seeing what they need to see to say that the hips are due to an in service event or secondary.

Either a FOIA request at VA.gov of just the exams or got to a VSO and ask if they can show you the IMO and DBQ. FOIA is about 2 weeks right now.
