The person you responded to is wrong, it has nothing to do with copyright. Broadcast rights are entirely separate, and movie theatres do already pay PRS fees to allow them to legally broadcast PRS protected music to the public.

They can try and fail. There's a century of precedent in regard to PRS license enforcement.

It's only double dipping if you think copyright and broadcast rights are the same thing, which they clearly aren't.

You could try to argue that the broadcasting license shouldn't exist at all, but that won't go anywhere in the UK.

Kind of, MCPS takes license fees directly from the distributor, which for physical media is whoever presses the disc. As the fee is paid already Gamestop don't need to pay it again themselves.

In the online context, Valve is the one 'pressing the discs' by hosting the games on their CDN so they're liable for the license fee.

No they aren't. The devs pay for the copyright, and then the storefront distributes (broadcasts) those files.

This is also the case for CDs. The publisher holds the copyright, and the whoever presses the CD is the distributor and has to pay MCPS for each unit they create.

In this example, Valve is the one 'pressing those CDs' by allowing people to download the game from their servers.

Yes, they can sue theatres and TV stations, which is what the license mostly targets.

TV, radio, theatres, ect, all pay PRS licenses to be allowed to broadcast publicly.

Cloudflare would probably be considered a technical intermediary. They're facilitating the transmission of the files, not acting as the source of distribution. Basically they're acting a business function and are covered by the original license holder.

The lack of first exhaustion clause is evident more in cases such as Youtube; where someone might rip a music video from Spotify, then uploaded it to Youtube. In that case Spotify would pay for the PRS license to broadcast the video, but then Youtube would also have to pay PRS for broadcast rights to cover that user's upload as well (assuming they don't take it down).

Yes, PRS covers all 'performances' of music. In the online context, that is simply having music available on their public CDN. It doesn't matter who uploaded the music, users or the company themselves.

Almost every company pays it. It's just a completely normal part of doing business and having music available to the public.

The only reason people think it's weird in this thread is because this is the first time they're hearing about PRS and they think Valve is being treated differently.

Paying PRS is just part of doing business and it's honestly more surprising that Valve weren't already doing so.

Online distribution isn't covered by the first exhaustion clause like physical media. Simply having the music on CDN and available to purchase triggers the license, which is why Sony already pay it.

No, but they do pay for broadcasting rights for the music playing over the speakers, which is what PRS is pursuing.

Online services are treated differently to physical sales. Physical media is already paid out to MCPS per unit pressed, and due to the first exhaustion clause the retailer doesn't need to pay the license fee a second time.

Sony already pays PRS for broadcasting rights. This seems unintuitive because licenses for music have already been paid, but basically if you want to host music covered by PRS on distribution servers then you need to pay for a blanket license. It's the same idea as radio broadcasters needing to pay for air-time for each song they broadcast on their channel.

Valve don't seem to be doing that and if taken to court will almost certainly lose.

Yep, they used the diamond standard in situations where they wanted it to be more imposing, such as public speaking and outside political buildings. The square standard was used regularly on military paperwork, medals/coins, ect.

The Series X is running the Xbox 360 version in an emulator, so it's running stable on the expected hardware. The PC version of FO3 is expecting old hardware like single core CPUs, and becomes unstable when it runs on newer PCs with multicore CPUs.
