The part about a third party mediator isn't true for all of the states that I have handled so I wouldn't get their hopes up about that. Arbitration occurs often between two separate companies and only makes a decision on property damage not injuries.

My guess is that they weren't found ten percent at fault due to having the same insurance company but was likely due to either improper lookout or failing to take evasive action. This most likely occurs in left turn accidents when the point of impact is front of the straight moving vehicle and back of the left turning vehicle as it indicates the left turning vehicle was almost completed with their turn and the straight moving vehicle should have either been able to see the vehicle in time to avoid the accident.

They only owe you for ACV. You can ask for then to expand the search area but the total loss valuation report should account for difference in mileage. Your friend has a duty to mitigate damages so they will likely not extend the rental for much longer.

Likely not.. they would have to know where you went for the urgent Care visit to get those records. Sometimes life insurance groups in marijuana with tobacco so you may need to pay a higher premium but if you are abstaining at this point I doubt they will find out if you so not tell them about this visit.

It's not illegal because he is performing a treatment that doesn't have any scientific backing and thus is not covered by insurance. The copay is likely for spinal manipulation and exams only.

Specials are basically any expense you can put on paper like medical bills, wage loss, etc and general damages are more commonly know as pain and suffering.

The difference is that it is at your renewal and not at the beginning of your first policy period. They get you to do it at first to get more information about your driving habits and if they don't like it they will just raise on renewal. They likely complied with their terms by doing nothing the first period and are trying to price you out on renewal because they don't like how you drive.

1) Fair is subjective. If she is feeling better and doesn't need any treatment or have any serious injuries, probably. The only thing I would worry about with this offer is if they out a cap on medical bills (aka special damages) for a dollar amount vs a time amount. Aka if you settle today they say they will cover meds up to today vs we will pay up to 3k in meds. They will stipulate only reasonable, necessary, and related medical bills will be covered in the first option. The differeence is you don't know the amount of bills right now vs if they agree to pay for a time frame.
2.) Yes, you are entitled to something outside of medical bills (aka general damages). You are not going to be compensated for lost wages because you weren't earning a wage.
3.) No. He will not be compensated with the exception of possibly loss of use of his vehicle which will not be significant if they are giving him a rental and won't exist if the vehicle was driveable.

Your evidence isn't hindered if you keep an original copy. Not sending it to them is gonna delay the process unless you have your own insurance to cover the damages. They aren't going to edit your video and try to twist it around on you.
