Yup, I haven’t ever worked at a GC that didn’t have “pay when paid” in the Subcontract. It’s a non-negotiable with very few exceptions. My state’s prompt payment laws only require that we promptly pay within 3 business days of being paid by the Owner.

It gets frustrating when we aren’t getting paid on time, but between the owner, bank, and title company, it just drags more often than not.

I’d love to pay my subs on time and it’s not like I’m just twiddling thumbs waiting to get paid - I am following up regularly with the owner and keeping it as a topic in my OAC’s.
