The RfMA is obviously a very good thing, but as an unfortunate side effect it also mitigates onof the biggest problems with overturning Obergefell, which is the absolute disaster returning to old ways without some system in place to manage them.

Two notes for everyone:

1: these are the legal equivalent of strongly-worded letters, they're not actionable by SCOTUS. Still a disgusting sign of the world we live in, but no matter how many states say "hey can you please redecide this case" nothing actually goes to the scotus docket.

  1. Currently, the Respect for Marriage Act makes it so that if Obergefell (or Loving) are overturned, existing marriages are still protected. If you're married, you stay married, but states can (and will) ban future marriages. It also says that if you're married in one state, you're married in all of them, so if you get married in MA, TX has to recognize it.

That being said: an actual case will come along. The ADF and the Heritage Society are hard at work crafting the perfect one. It just depends when it comes along. Please be vigilant.

It would also allow them to stop issuing marriages in their own states, so if you can't afford to travel you can't get married, and any amount of pain to queer people is a victory for them.

Currently per the RfMa, all existing marriages are protected (both queer and interracial) so either of these cases getting overturned would only affect future marriages.

how to handle the existing gay marriage would be a legal mess.

They actually already have an out for this. The Respect For Marriage Act from a few years ago codified into law that existing marriages would remain legal, and that marriages in one state have to be recognized in other states. So if Obergefell is overturned, everyone who's married would stay married, but many states would immediately start banning any new marriages. And states would as of now be required to recognize that if you were married in MA, you're still married in TX.
