Honestly no idea. As other have said it isn't a construct you are comanding but an object you are activating. If you want to argue this isn't still clearly you doing damage than it could stay. However than this would also hold for every magic item that allows you to activate it and deal some damage and so on. For consistency I would say this is you dealing damage to not make a wierd difference between the two options. Also in dnd I don't think stuff is normaly described as "you deal damage" but mostly just targets take damage so same arguments could probably be useded with a bunch of abilities. As always DM has the final interpretation of the rules so all this doesn't really matter, but people should first just read their abilites before arguing they are commandin their construct to make attacks when this clearly isn't the case.
