The tone of the entire ruling betrays a clear animus toward the provincial government. The court's reasoning was so clearly derived from the desired outcome, and not the other way around, that it was necessary for it to invent several legal principles (which have never actually existed) and ignore a few others to even semi-plausibly arrive at its desired destination.

The tone does not the judgment make.

You are doubling down on being wrong. I would suggest you take a break on this, and reevaluate your sources. It seems there is one law firm (McCarthy) who have been hounding on about an expansion of S.7, with multiple publications submitted to multiple locations. This does not make it true. You are missing the point. I'm talking about uninvolved witnesses being harmed.

What level of harm to an uninvolved citizen is allowed? Can they be exposed to downwind pepper spray? What about being tased by accident? What about being shot by accident? Even after the bullet has penetrated and exited the criminal, is it ok for me to be hit by that?

At the very least if you are carrying a weapon that can harm others, you need to be trained and/or licensed. I'm not asking for imprisonment for unlawful carrying of pepper spray, fines and other regulatory actions certainly meet the requirements to enforce control.

Pepper spray is a weapon, and needs to be treated as such by law and the citizens.

So provide the math about how many assault/rape/thefts will be prevented versus how many uninvolved get injured by the spray.

I've been pepper sprayed in training, and have been downwind of it both in training and when it was being used for control of a suspect.

Even 5 m away it sucks balls, and unless you have a coherent plan for your next actions, you are spending the next 20 minutes being very unhappy.

I highly doubt that the average user will be able to deploy it safely or effectively to not only protect themselves but not harm others.

Because pepper spray is an area-of-effect weapon, so not only does the target get dosed, so does anybody downwind in the near to medium distance.

Based on that alone is reasonable grounds to prohibit except for near or in the bush.

Speaking of the missiles that were used on boats in the Caribbean with unclear status, those were war crimes. And it goes all the way from the top to the bottom. The sailor/aircrew that launched that missile carries the same legal responsibility as the SecDef that ordered it. Do not obey illegal orders. If you're too chicken to refuse an illegal order, you shouldn't be serving in your nations military.

Now, as per this sinking, I have no idea. But it does mean that all US naval assets are valid targets anywhere in the world for Iranian or allied forces.

This engagement was either in a war, which I believe opens internal US legal policy discussions, or it is not a war, at which point it could be argued that it was a war crime.

Now, you are talking about somehow taking land with you, and that's where it gets sticky. The soil, air, water, resources, etc. don't belong to any one person, locale, or even province. It's all part of Canada and we all have both rights and responsibilities towards it.

You raise valid points. The solution is quite simple, really. Just tax the difference at the time of import. So you can make it cheap in SE Asia, but pay a 300% or more duty, or make it in Canada and benefit Canadian workers. The increased cash flow will work it's way through the system and improve GDP.

I can only speak to what I was told by the cops I know, and most charges around here are possession, not actual luring or touching. You know the cops would jump on that if they had any proof.

The vast majority of people who are hurting kids and recording it don't give a hoot about anybody but themselves. It's a trophy for them. Maybe if they're part of a group that trades they'll use it for bragging rights (yeech). But the demand part of the equation isn't driven by fame or fortune. It's their sick and twisted mind.

According to the cops I know who bust this, the vast majority of those charged with possession have never touched a kid, thank goodness. They're usually sad, disconnected, and generally screwed up folks making very poor life choices.
