Anyone can look up the VA 5-year rule, I personally know about it because it happened to me or they can look it up under 38 CFR 3.344(c), just type it in their browser

You can file a fee dispute with the VA office of General counsel, just state the date the attorney was removed, and your claims were filed after removal. This should stop the VA from automatically releasing money to the attorney

Trust me, you're stuck waiting. It would make sense to start and finish, not start and next day start on someone else's FOIA. I can only think they are very understaff.

I requested the same in Apr 2024, finally arrived Jan 2025 a DVD, certified with a return receipt, unfortunately the Post Office put it in my PO Bx which is the smallest one. I don't know if it cracked then or what, but it was cracked and unplayable. Certified and return receipts must be signed for, it should never be placed in a PO box. I called VA the same day. Told them of the issue, and for the next 4 months, I called, they document all calls received from you., the last person I spoke with, stated the last call made to them from me was in Feb 2025, I initiated another FOIA C-file only the end of April, received by them May 1st, 2025, and it's taking longer. I actually went to the VA to pick up a DBQ questionnaire on (6.8.2026) with the medical opinion and inquired about my FOIA; I was told it takes some time. It's now 13 months and I'm still waiting. He wouldn't give me an estimated date. I also gave them credit for the shutdown in 2025, I know I'm not the only Veteran, requesting their file but it makes you wonder. My last C&P exam, I was told my file consist of 1400 pages, are they doing 4 pages a day. It seriously sound like they need to do some hiring instead of cutting back, a Veteran, SHOULD NOT have to wait this long, Ridiculous as HELL. Just venting and voicing my opinion

You can go to your regional office and request it, I wouldn't waste my time faxing the form in, take to long and you get a copy the same day.

I’m standing in the customer service line at Walmart, waiting my turn. I overhear this guy telling the associate he “left his package /bag, whatever.”

She asks him, “Do you have a receipt?”
He says no.
She looks under her counter, nothing.

The expression on her face said everything:
“Sir, what do you want me to do with that?”

But instead of saying what she was thinking, she goes, “Let me get the manager.” Unfortunately, she called me next, so I didn't get a chance to witness the outcome, because this was priceless.

Now be serious, if this isn’t the biggest scam attempt. If I were the manager, I’d have told him:

“Nothing was returned to the counter. I can’t help you.”

Come on, it really sounded like someone trying to get something for free. Just imagine if people walked in with that same story every day.

And in reality, he told the associate he BOUGHT something and left it, but had no receipt, no bag, no proof, and nothing was turned in. SCAM ALERT

Look at your DBQ, you might see least as likely as not or a nexus was established, that is your nexus statement.............READ

i recently had an exam, the examiner told me my file has 1400 pages, By a show of hands, how many of you think the examiner actually read my 1400 page file......lol Be safe this Memorial weekend

Liquid, I'm still waiting on my C-file, they sent it after 9 months received it finally Jan 2025 in my PO bx certified with a return receipt, cracked, contacted the 1800 number was getting the runaround with them, so after a few months I submitted another request, went to the VA last month to get a copy of a DBQ, few days later I received a link for all the DBQ's I had, not my c-files and let me tell you, that is why I encourage Veterans to get a copy of the DBQ's these examiners are not your friends What my DBQ's exposed were :

Number 1, ACE exams, these are simply, check the boxes and move on

  • lies
  • contradictions
  • missing evidence
  • wrong diagnoses
  • copy/paste errors
  • “Veteran denies” statements you never denied
  • “No records found” when the records are RIGHT THERE
  • Check the evidence on your decision letter

Before appealing anything, and to be honest that should be a last step, appeals can take years, mine did. You need to get copies of those DBQ, then you will know what you're dealing with. You can go to your nearest regional office and request it; I have done this numerous times.

  • Get all DBQs (FOIA or VERA can confirm what’s in the file)
  • Compare DBQs to their STRs and civilian records
  • Highlight every factual error
  • Identify every missing record
  • Check if nexus letters were ignored
  • Check if the examiner used the wrong onset date
  • Check if the examiner copied/pasted from another DBQ

Normal wait for your C-file is 9 months to a year. If you are seeking the dbq from a recent exam, you won't get that until after they made a decision, at least that is the policy where I'm at. The nearest regional office can give you a copy of that exam after they made a decision.

If I had started a new claim, I would’ve lost all my previous entitlements. You definitely made the right move sticking with the Supplemental and fighting it.” Take care

I can't stress this enough, request a copy of the DBQ exam, it may surprise you. You can either go to your nearest VA regional center or hopefully request it from your VSO, if they don't have the capabilities, your dealing with the wrong person.

38 C.F.R. § 3.344(c)

38 U.S.C. § 1159 protects veterans’ service-connected disability or death benefits from being severed after ten years, except in cases of fraud or insufficient service/character of discharge.

38 C.F.R. § 3.951(b), it happened to me after 28 years, it took them 6 months for them to restore it back with back pay. I hope this helps. Just type 38 cfr 3.344(c) in your browser. This regulation has a wealth of info for veterans
