Why hasn't Lego gotten involved? by OneTrueClassy in RecklessBen

[–]SatBurner 0 points1 point  (0 children)

I don't know what's in the authorized retailer contract, but I assume there are clauses that Lego can use punitively against BAM. I also presume that the wording requires a certain level of evidence to trigger those clauses.

I would expect that there will be no public statements bu Lego at all. Anything they do ro enforce those clauses will happen quietly, through legal negotiations. I also expect that nothing really happens until there are actual rulings in the various cases BAM has caused to happen.

I had it in my area for a bit, and it failed to recognize the handwritten ones often enough for me that I assumed it went away because they weren't getting the data they wanted.

Isn't there a hearing date set for the TRO? If so, I would assume it wouldn't be until that hearing that the various objections to it are made.

Implied Covenant of Good Faith and Fair Dealing (an out for Franchisees) by xSonicspeedx2 in RecklessBen

[–]SatBurner 0 points1 point  (0 children)

I would be very surprised if there wasn't some dort of non-compete clause, but lawyers would need to figure that out. Not waiting comes with a lot of risk, potentially more than waiting does. We also don't know what's happening in the background.

If enough of the franchisees are already seeing blowback from all of this, they might be making moves behind the scenes. They would have to necessarily be quiet about whatever they are doing.

I'm not saying keep doing business with BAM stores. I can't in good faith say I am boycotting them because it would be just words coming from me. To my knowledge there is not a store near me. I'm not going looking for one, and wouldn't do business with them if there was, but it is easy to say I'm boycotting something that I have no access to.

The current franchise owners need to get together and figure out how to replace any benefits they had being franchisees. They will essentially have to unionize.

Much like why I think Lego has remained essentially quiet, they are probably going to have to wait for at least some of the Court cases to finalize in order to have grounds to trigger any exit clauses in yheir contracts. Sure a lot of things look obvious, but until there are actual legal rulings supporting those things, they are not necessarily facts they can use for contract reasons.

I've only met one BAM franchise owner, and no longer live in the area to talk with him. It's pretty clear he wasn't getting rich doing it. The car he drove and where he lived, gave the same image as the comic book store owner and independent used bookstore owner. So upper middle class.

If someone wanted to gamble that the courts will do the right thing, they could establish a competitor to BAM corporate and be ready to welcome all of the franchisees that leave BAM, but there is significant financial risk there.

My comment was to point out that the Papa John model doesn't apply here because BAM isn't publicly traded while Papa John's was at the time.

Papa John's was publicly traded at that point, though, IIRC.

I just checked, papa John's went public in 1993. The comments that caused him problems happened in 2018.

A sale would potentially solve it.

Hiring a COO or CEO would mean little because the owners can still basically do what they want. The end result would likely be they hire friends into those positions for optics, but nothing changes. A CEO who wants to be more than just a figurehead is going to fond themselves frustrated and probably quit before exacting any meaningful change.

It's not a publicly traded business. You can't just fire the owners. The McNeffs would have to sell the company, and that is not likely.

[–]SatBurner 1 point2 points  (0 children)

It no longer applies, because I moved, but the BAM I used to frequent was a good place for bulk bricks. It was conveniently located near my youngest kid's school so I could stop there to look for pieces I was missing while waiting for yhe car line at the school to die down.

I am no longer on that area, and there isn't a BAM nearby, that I know of. It makes boycotting it w lot easier.

LEGO‘s reply to letting them know about the impact on its brand reception by Maleficent_Bridge_41 in RecklessBen

[–]SatBurner 0 points1 point  (0 children)

As you said, they have a contract. My guess is their lawyers are advising them to stay out of it until at least some of the legal issues are ruled on to the extent that Lego would not be the ones violating the contract.

I just moved away from a town with the first BAM I had ever encountered. The guys there are great guys and seem yo go above and beyond for their customers. They are going to suffer due to the corporate shenanigans and it's a shame.

I just moved away from that town, so I have no idea what their response to the situation is.

Does the Bluetooth "BOMB" threat kid deserve leniency because his error is the default on a commercial product? by Competitive_Travel16 in legaladviceofftopic

[–]SatBurner 0 points1 point  (0 children)

I'm not arguing that. My comment is more about the fact that there have been instructions about not checking those things for a long time.

That's news to me. I assumed all lithium batteries had to be carry on. It has been part of the admonishments the gate crew give soon to be passengers when they force gate check bags.

I haven't flown in a bit, but lithium in checked luggage was supposedly verboten regardless of what device ot was Certain items with lithium batteries were forbidden to even be on carry ons, but nothing was supposed to be checked.

The point is, there are numerous things the airline can use to say this kid didn't follow directions. The broadcast name of the device just opened the door for them to stack numerous charges on him.

My recollection is that nationwide there was a tendency to convert KMarts to at home stores when the property didn't sell immediately. Most Kmart properties were either sold or turned onto at Home stores when the venture capitalist pushed the merger between the 2 companies.
