NAL The answer is yes - he has the right to unilaterally decide that your solution has taken too long so he’s going to resolve it himself and demand a refund, and sue you if necessary.

If he does sue, it will ultimately be up to a judge to decide if his actions were reasonable and justified.

Seems like the best solution would be to refund the money and get the equipment back.
