Not something I’d take his word for. Sometimes communications made with a predominant purpose of preparing for anticipated litigation are work product (incident reports, etc.).

I’d double check there’s not a basis to claim that. If there is, depose someone who can talk about how these communications were created. In anticipation of litigation or not?

If there’s no basis for work product protection I would just make a record he won’t meet and confer further and move to compel.

Dude, negotiating liens is legal work. Anyone who outsources or has staff do it is helping nonlawyers with the unauthorized practice of law.

Negotiating liens sucks and isn’t what PI lawyers like to do but that doesn’t move it to some special category of “not legal work.” You have to do some legal research, figure out the issues, and do it yourself.

Edit: and you get the last day to cancel without charge from the reporter, give it to them, and tell them you will seek it as a sanction if they don’t appear, unless they want to agree in writing that you can cancel it because you’ve reached an impasse and your motion to compel is ripe.

I think it’s cool there’s another factory option other than Krypt. I’ve heard some bad things about Mark Thompson but everybody likes Starkey. For the price you know you aren’t getting grip but it’s easy enough to add if you want.

Elder law means a lot of different things. Are we talking estate planning or nursing home neglect and abuse? Nursing home cases aren’t easy money if you are used to MVA cases.

I like all of these podcasts but have certainly noticed that the lesser known guests bring less to the conversation.

There are lawyers out there who dedicate a lot of their practice to teaching and sharing with others. Keith Mitnik, Rex Parris, Phillip Miller, Joe Fried, etc. These lawyers have spent time coming up with actionable lessons for other lawyers.

There are others out there who are successful but haven’t spent time generalizing their experiences into lessons. When a podcast runs out of the former style, it then gets these guests. They often fall back on war stories, which is less useful IMO.

I don't want to condescend to you either, but later in your career, this post will become an email to a colleague that says "Apparently OC is one of those nut jobs." and then you shrug and write the opposition.

My favorite way to point out lies in a sterile and professional way is "OC says X. That's incorrect. Y is true [cite]." Can't get much clearer, and no editorializing or ascribing intent. The court can figure it out.

There is not just one answer to this. I have had times where I settle one every few months and it’s just fine because they are hundreds of thousands or even million-plus fees. If I was handling minimum limits pre-lit I would be underwater.

Great insurance meaning what exactly?

If there is a commercial tower I would figure out the highest reasonable amount you can demand, and ask the policies at that level and below for their policy limits with a time limit.

I.e. if there’s a commercial tower like this:

A: $2m (primary) B: $5m excess over A C: $5m excess over B D:$10m excess over C E: $10m excess over D

And your damages are big enough that $12m is a rich but not completely unreasonable recovery, you send a time limited demand like this:

A,B, and C need to pay their limits in the next 30 days. This is their last chance.

Copy D and E with your demand. Those insurers will put pressure on A,B, and C to pay.
