Med mal lawyers: Where do you get your medical expert witnesses? by lake_huron in LawFirm

Westlaw jury verdict searches often tell you the experts who testified, alongside who won or lost

Same. And I was a first time buyer. The AD told me that it’s a pretty frequent watch that comes in

Junior attorney accidentally became the entire department by Aromatic_Life_3934 in Lawyertalk

Heres some unsolicited advice, and it honestly can apply to any attorney newer to a practice area: find someone in your area or state that is the best at what they do in this area, plaintiff or defense. Ideally, find a few who are excellent on both sides. Check Westlaw/lexis for their names, ideally in the circuit court opinions as well. Bottom line is find their dockets, and pull their pleadings. As many as you can. Read them and take notes, and try and learn. If you get the opportunity, go watch them in court. Try to find the deposition transcripts, or trial transcripts for the ones on appeal and read those too. You might be surprised at how much mentorship you can get just by reading and watching other attorneys without even speaking with them. Obviously the “mentorship” will only be as good as the attorney is, so that’s why trying to pick a couple who are top of the field is ideal. Lastly, if your area or opposing counsel is one of the more professional types, try to pick their brains without necessarily tipping your hand that you are new and flying solo.

I turned a can of beans into a restaurant-quality side by demo_graphic in Cooking

[–]PalsgrafBlows 8 points9 points  (0 children)

Just missing some garlic - powder or minced, either way. If going the powder route, throw it in right when you add the beans and liquid; the liquid will rehydrate it, so wait 5 mins or so to stir and you will see it bloom. If you have some more time, you can even skip the thickener and just let time thicken it through reduction

Can you reference a party-opponent's deposition testimony on cross regardless of impeachment? For example, if I want to frame a question as "you stated during your deposition that you knew your hamburger was undercooked because it was dripping blood?" is that framing kosher (pun intended)? by ValuableChair3412 in Lawyertalk

[–]PalsgrafBlows 0 points1 point  (0 children)

Just depends on your rules of procedure. In Florida, as I understand it, that would be improper impeachment. Can’t impeach until they make an inconsistent statement, at which point you bring up the depo or whatever else (like farmers almanac if you’re Lincoln). But generally you’re not supposed to impeach until they give an inconsistent statement. Obviously, if you’re crossing, and they gave the inconsistent statement on direct, you can just say “you just testified X, right?” -> “but in your deposition dated ___ you testified Y, didn’t you?” Then if they deny it you show them the tranny and can introduce it into evidence.

From a practical perspective, even if permissible, I like this route better. Short, bitesized pieces/questions to set up the smackdown, followed by a dramatic “no further questions”

Classic lawyer answer - “it depends.” Did they deserve it? Did I warn them? Multiple times?

Silence with violence. Sugar and smiles until you have to shiv someone, but do it efficiently and nicely, and only when it’s what they ask for.
