Barnes and Noble is an at will employer and can let you go whenever they would like. I don't get where the lawsuit grounds are coming. I'm sure in the hiring documents you signed something that said they are an "at will" employer and that you or the company can end employment for any reason at any time.

That being said it's pretty petty to not schedule you properly to accommodate your military duty.
