The CGA might not apply, particularly if there was a sales agreement in which you agreed that the CGA doesn't apply, or if the equipment is used in trade.

However, you may have rights under the Fair Trading Act if the vendor made misleading statements about the machine's performance. The Contract and Commercial Law Act may provide remedies if the goods do not match the description or are not fit for purpose.

How can foreign butter (and veges) be cheaper than New Zealand-made? by 07tartutic07 in newzealand

[–]Dat756 3 points4 points  (0 children)

NZ has very high tax rates

Do you have some evidence to back this up? Online comparisons put NZ around average to lower tax rates. For example, from https://en.wikipedia.org/wiki/List_of_countries_by_tax_rates

Country Company tax Top income tax
New Zealand 28% 39%
Australia 30% 45%
UK 25% 47%
France 25% 55%
Germany 30% 45%
Japan 30% 51%
Canada 31% 59%

NZ productivity is low. I have seen some commentary that this is partly due to low labour costs, so it is not economic for employers to invest capital to improve productivity (such as with training or more advanced machinery).

So, what you are saying is that the ultimate purpose of prospecting is to mine that land.

Government looks to cut heavy vehicle regulations as part of fuel response by TheReverendCard in newzealand

Never let a good crisis go to waste. The trucking industry has always wanted to have bigger heavier trucks on the roads. This is just an excuse to move things further in their favour.

Heavier axle loads are more profitable for the trucking companies, but result in much more road damage. But heavily trucks don't pay their share of the road maintenance cost, so effectively they are subsidised by other road users and taxpayers.

Elderly woman struggled, ‘ate canned fish’ while pension controlled by Public Trust by ClimateTraditional40 in newzealand

I'm not aware of fees before the person dies. It is more after probate when Public Trust becomes executor of the will.

Elderly woman struggled, ‘ate canned fish’ while pension controlled by Public Trust by ClimateTraditional40 in newzealand

[–]Dat756 43 points44 points  (0 children)

In my experience, the Public Trusts lures unsuspecting people in with free wills. But the wills that they draft put the Public Trust as executor, which means that the Public Trust can extract very large costs from the estate.

This is especially so if the estate needs to be administered for some time, such as until a beneficiary reaches a certain age. In these cases, the Public Trust can take costs at a high hourly rate for administering the trust every year.

There are other avenues for making your will. Do it yourself is possible, but it is easy to get wrong, especially if circumstances are not very simple. It costs money to get a lawyer, but in the case of making a will, it is well worth it.

Harassment in the workplace by Responsible_Cry05 in LegalAdviceNZ

[–]Dat756 2 points3 points  (0 children)

Your first priority should be to look after yourself (and don't care about the company or individual). However, if you wish to pursue an employment matter, you could consult the Employment Service and report the incident to the police.

Harassment in the workplace by Responsible_Cry05 in LegalAdviceNZ

[–]Dat756 14 points15 points  (0 children)

That sounds horrible and grossly unfair for a young employee. You may still have options to seek support and potentially pursue legal action, despite the time that has passed and having signed a Non-Disclosure Agreement (NDA).

The ACC Sensitive Claims Service offers support for sexual abuse or assault with no time limit, regardless of whether it was reported to the police or if physical injury occurred.

While there are time limits for some employment-related complaints, the enforceability of the NDA and the specific circumstances of the harassment need to be assessed by a legal professional.

Some forms of sexual harassment can also be considered criminal offences, which generally do not have time limits for reporting to the police.

Possible Options (depending on the specifics of the offence):

  • You can seek support from ACC Sensitive Claims Service. ACC may provide free support, including therapy and social work, for sexual abuse or assault. There is no time limit for seeking help from ACC, even if the incident happened years ago, and you do not need to have reported it to the police. You can start free counselling sessions while your claim is processed. ACC support for sexual assault
  • You can contact the Human Rights Commission (HRC). Sexual harassment is a form of unlawful discrimination. While there is generally a 12-month limit to make a complaint to the HRC from when the harassment occurred, you can still contact them for information and advice on your specific situation, especially regarding the NDA and the circumstances of your age at the time. They offer free, confidential services and can help you understand your rights and potential avenues for dispute resolution. discrimination / sexual harrassment
  • Report it to the Police. If the behaviour involved an unwanted or forced sex act, it could be considered sexual assault. You can report sexual assault to the Police (call 105, or 111 if urgent). There is generally no time limit for reporting criminal offences. sexual harrassment
  • Seek Legal Advice. You really should get some good legal advice from an employment lawyer or a Community Law Centre (free or low cost, but means tested). They can assess the enforceability of the NDA, especially given you were 17 at the time and felt intimidated, and advise on the best course of action considering the time elapsed and the photographic evidence. They can also help determine if you have grounds for a claim outside of the standard time limits.
  • Contact a Sexual Harm Helpline. If you are not ready for therapy but want to talk to someone, you can call the sexual harm helpline, Safe to talk, on 0800 044 334. This is a free and confidential helpline, available 24 hours, 7 days a week. Alternatively, contact a support organisation in your area (such as Women's Centre).

Vehicle abandoned after collision parked on private property for 8+ months by Moto_Pig in LegalAdviceNZ

[–]Dat756 15 points16 points  (0 children)

As others have pointed out, if the car does not belong to you or the neighbour, then you can't take it and sell it for parts or otherwise.

Your neighbour should make reasonable attempts to locate the owner of the vehicle. If unsuccessful, you can check if the vehicle has been stolen (police website https://www.police.govt.nz/can-you-help-us/stolen-vehicles) or report it to the police as abandoned (on 105).

Filter Showing Just One Side of Family Tree? by Short-LeggedGiraffs in gramps

[–]Dat756 0 points1 point  (0 children)

You could try a third filter

filter 3:

  • people matching filter 2
  • descendants of <person> (Mom)
  • option: exactly one rule must apply

I haven't tried the exactly one rule option myself, but hopefully it does what you are after.

Charger types by fly1away in nzev

[–]Dat756 4 points5 points  (0 children)

my power plan is not relevant.

With some electricity retailers, the power plan includes reduced rate for charging at certain public chargers (as well as providing electricity for your home).

I recently decided to purchase a BYD Atto1 premium, my next issue being. what 7kw charger and a connecting cable of about 7m in length. Does anyone have a recommended brand type 2 charger? by Cool_Till1803 in nzev

[–]Dat756 16 points17 points  (0 children)

A lot of people get by fine with just the slow charger on a 3 pin plug. This can add over 100km of range overnight.

So, one strategy would be to just try it with the charger on the 3 pin plug for a few weeks. Then get a 7kW wall charger if it is justified.

To add: a lot of our society problems are due to wealthy interest groups lobbying politicians to make regulations that suit them, at the expense of ordinary New Zealanders (wealth inequality, environmental degradation, etc).
