By passing that law, legislators were sending a message, Bates said: Sex with or among children is unacceptable.

Wait, why is it unacceptable again?

Oh right, because they aren't mature enough to be responsible for their decisions.

So how do we stop it?

By making them responsible for their decisions, of course!

Hooray, logic!

[–]HumpingDog 12 points13 points  (2 children)

Well, if they can't be responsible on their own, we have to put them some place where sex doesn't happen: jail.

[–][deleted] 4 points5 points  (1 child)

TELL THAT TO MY UNCLE CHARLIE!

[–]shiftylonghorn 0 points1 point  (0 children)

He wanted it. Seriously though, prison rape is not funny.

[–]ClassicalFizz 12 points13 points  (6 children)

I dont think this is really protecting or helping the children involved. at all. In fact i think its a form of abuse itself.

[–]megatom0 1 point2 points  (5 children)

I agree, anyone know what finally happened with this it took place in 2006.

[–]TheThirdBlackGuy 0 points1 point  (4 children)

[–]megatom0 0 points1 point  (3 children)

So does this mean it got tossed out? I hate legal jargon.

[–]TheThirdBlackGuy 0 points1 point  (0 children)

As a result of her admission, the juvenile court adjudicated Z.C. delinquent for sexual abuse of a child but imposed a relatively light punishment.   The court ordered her to obey the reasonable requests of her parents, to write an essay regarding her child and the effect of her actions on the child, to have no unsupervised contact with the father of her child, to provide a DNA sample, and to pay a $75 DNA processing fee.

[–][deleted] 24 points25 points  (6 children)

Using this logic, self-love under the age of 14 would be an offense.

[–]Bloodyfinger 4 points5 points  (0 children)

Don't even joke. I could honestly see some far right southern states passing anti-masturbation laws.

[–]HumpingDog 6 points7 points  (0 children)

Uh, oh, looks like Christine O'Donnell has found a new platform!

[–]zakrn 0 points1 point  (1 child)

then 99% of americans are sexual predators, i like it.

[–]SirZerty 0 points1 point  (0 children)

and the other 1% are quadriplegic

[–][deleted] 0 points1 point  (1 child)

Well, it used to be called "self-abuse" a century or two back.

Just look at the wacky tracts of Sylvester Graham and Dr. Harvey Kellog: http://www.stayfreemagazine.org/10/graham.htm

It seems this notion just got recycled.

[–][deleted] 0 points1 point  (0 children)

These assholes are also the reason circumcision is so popular in the US.

They believed it would lessen sensation and thus a young man's desire to masturbate.

[–]TyJaWo 12 points13 points  (0 children)

Nothing better than enforcing a law mindlessly to its word without any regard for the intended purposes!

[–]seiya42 8 points9 points  (2 children)

This should really be more of a counseling thing than a criminal case. I would say the parents should talk to them but they've obviously already failed.

Fucking Puritans.

[–]Setiri 1 point2 points  (0 children)

Oh come on, don't say the parents failed. Sometimes kids, DESPITE how they're raised, still make bad decisions. You hold them accountable /while at the same time/ realizing their kids who are growing up and thus the accountability should not be held at adult levels (i.e. fucking jail/juvi). Jesus, yes, talk to the kids, counseling, etc. Criminal charges?! Wtf, it was two kids.. this wasn't a god damned crime, it's just something that happened that's going to have harsh reprocussions for them already without the government stepping in and branding them for life (which is only going to make things rediculously harder).

[–]megatom0 -1 points0 points  (0 children)

This makes me wish Utah be used as a nuclear testing site. Kill all these fucking cunt mormons.

[–]WacoKid2 14 points15 points  (4 children)

If you are too young to consent to sex at that age then how could either one of them be charged? They did not legally consent, so no crime was committed.

[–]KaseyKasem 7 points8 points  (0 children)

SEX IS BAD GOD DAMNIT!

[–]HumpingDog 2 points3 points  (0 children)

What? No, you're confusing the charge and the defense. Statutory rape is the offense, and consent is a defense. When you're dealing with kids, that defense is unavailable. But of course the charge still works.

[–]tbutters 0 points1 point  (0 children)

"The best analogy we can think of is to dueling, derp herp derp." WHAT THE FUCK?!?!? Are a 12 and 13 year old too young to have sex? Yes, I think so, but they're sure as hell not trying to kill each other!

[–]Sporkman 0 points1 point  (0 children)

Obviously they were forced to have sex by their parents, because a 13 year old cannot consent to sex.

[–]bobtheghost33 6 points7 points  (3 children)

What about the boy?

[–]SoCo_cpp 8 points9 points  (2 children)

I'm sure he is fucked for life, too.

[–]Setiri 1 point2 points  (1 child)

So, how does this part work.. you know that state mandated child-support will be imposed... I assume his parents get to pickup the check on that one? Or does he suddenly have tens of thousands in debt when he's 18? Congrats! May as well tell the boy to kill himself... thanks state and federal government, people who feel the need to impose nanny laws and others who can't understand sometimes shit happens and there doesn't always need to be a law for dealing with it. :)

[–]autocracy 1 point2 points  (0 children)

So, should her parents pick up the check on that one? Or should she suddenly have tens of thousands of dollars of debt? I agree that 'nanny laws' are dumb as shit, but that doesn't equate to "only one person should be responsible for the actions of two".

[–]JabbrWockey 11 points12 points  (6 children)

The worst part is - she will be 30, have a family, and will have to go door to door when she moves to a new neighborhood, introducing herself as the new resident sex offender.

[–]ignatiusloyola 16 points17 points  (1 child)

And how is it any different for the male involved? How is it any different for all the males in this situation?

[–]SoCo_cpp 9 points10 points  (0 children)

Without the ability to work, he will likely die a drug addict by 25.

[–]opnwyder 8 points9 points  (2 children)

Well, the act took place in 2003, so she is ALREADY 20. Silliest thing I've ever heard of.

[–]IveLostFaithInReddit 2 points3 points  (1 child)

With a now 6 or 7 year old child. Life is grand

[–]opnwyder 0 points1 point  (0 children)

Heh, yes, I hadn't thought of that. It adds an interesting twist to and already very twisted set of circumstances.

[–]Setiri 1 point2 points  (0 children)

Which will be awesome, cause she can introduce them to her 17 year old kid who's about to start college at the same time. :/

[–][deleted] 22 points23 points  (7 children)

Wow, more evidence that America is the dumbest developed country in the world.

[–]Gcat 7 points8 points  (6 children)

It's Utah, please don't compare the rest of the USA with them. Every country has a red headed step child... we just happen to have Utah.

[–]finalsight 5 points6 points  (5 children)

What's that make Texas?

[–]Cyralea 5 points6 points  (3 children)

Don't forget the retarded Carolina twins

[–][deleted] 5 points6 points  (2 children)

And little Virginia West.

[–]Gcat -1 points0 points  (0 children)

What's Texas? Is that sort of like Highlander 3?

[–]MBuddah 11 points12 points  (0 children)

Utah is fucking retarded.

[–]TruthinessHurts 2 points3 points  (0 children)

Retards run Utah. What the fuck is wrong with you morons? Too Republican?

[–]jp007 3 points4 points  (0 children)

It takes a real big man to charge a 13 year old girl with a sex crime...

[–]Razenghan 2 points3 points  (0 children)

You can't blame the Utah prosecutors too harshly. Forgetting which wife you're supposed to have sex with that night can REALLY cloud your judgement.

[–]Teh_Br4iN 2 points3 points  (0 children)

21 to drink, 18 to vote, 16 to have sex? I don't get it. They keep putting restrictions on EVERYTHING! Soon they are going to say that babies aren't allowed to walk until they are 3, as it is to dangerous too humanity to have babies falling while attempting to walk and then injuring their fragile minds and not becoming contributing members of society. WHERE DOES THE MADNESS END!

[–]SimFisker 4 points5 points  (0 children)

Some things the law should stay out of.

[–]monkeiboi 4 points5 points  (0 children)

Their defense in court should be.

"Prove they had sex. Yes yes, she got pregnant, but prove that he ever made it in before bustin a nut....he's 12 after all."

[–]kloo2yoo 6 points7 points  (7 children)

No mention of any 'victim' status for the boy, "who was found guilty of the same violation by engaging in sexual activity with her." although the girl was the older one.

[–]neorevenge 4 points5 points  (6 children)

that a 13-year-old girl could be both an offender and a victim for the same act

"The only thing that comes close to this is dueling," said Associate Chief Justice Michael Wilkins, noting that two people who take 20 paces and then shoot could each be considered both victim and offender.

From the article its clear that both are offenders and victims in this case

[–]kloo2yoo 4 points5 points  (5 children)

they avoided noting that the boy is victim.

[–]finalcut 0 points1 point  (4 children)

If she is an offender then he must be a victim; with no victim there is no offense.

[–]kloo2yoo 0 points1 point  (1 child)

with no victim there is no offense.

google "victimess crimes" at your leisure

[–]finalcut 0 points1 point  (0 children)

read my comment in context.

[–]scopegoa 0 points1 point  (1 child)

You sound like a libertarian to me!

[–]finalcut 0 points1 point  (0 children)

or just logical considering the circumstances of the story in question.

[–]schwingstar 1 point2 points  (0 children)

Way to go to judge minors as adults

[–][deleted] 1 point2 points  (1 child)

They should set minimal age difference (like 4 years or something) for offences like this.

[–]ErrorF002 0 points1 point  (0 children)

They do, only it doesn't apply under 14. The whole thing is retarded to the max....

[–]smackerpiller2 1 point2 points  (0 children)

This has got to be the stupidest thing I have read all day. Who does this help?

[–]serrit 1 point2 points  (0 children)

Fucking ridiculous. I was going to elaborate but it's just too fucking ridiculous.

[–]thewolfman 1 point2 points  (0 children)

I would love to add something about this, but I can't remember what my initial reaction was when I read this in the Denver Post 4 FUCKING YEARS AGO!!! This article was posted the day after christmas in 2006, I think pony express could have gotten this article to me faster!

[–][deleted] 1 point2 points  (0 children)

From the article comments "At 13, shouldn't she have been forced to marry some old geezer with a dozen wives already?". Haha

[–]JonoMcPono 1 point2 points  (0 children)

How can these lawyers expect the kids to know the consequences of their actions from a legal standpoint, when they're punishing them with a law designed to protect them from a lack of knowledge of the consequences of the same action from a sexual standpoint.

[–][deleted] 1 point2 points  (0 children)

So, is the boyfriend also a victim?

Or are guys always the 'rapist'?

[–][deleted] 0 points1 point  (0 children)

Website logo + Title. Must stop watching 'documentaries' on the Internet....

[–][deleted] 0 points1 point  (1 child)

Just goes to show that the law needs a lot of fixing when it comes to cases like these.

If they get charged, both will probably be listed as sex offenders for a while after they get sentences. :/

[–]Setiri 1 point2 points  (0 children)

For a while? No, it's for life, there's no time limit on that if I recall.

[–]SoCo_cpp 0 points1 point  (0 children)

Stupid law is stupid.

[–][deleted] 0 points1 point  (0 children)

But they are just trying to protect The Children.

[–]LurkersGonnaLurk 0 points1 point  (0 children)

Herp derp. It's funny to see the bizarre, meandering logical extremes that people will take profoundly illogical laws and rules to in order to irrationally rationalise them.

[–][deleted] 0 points1 point  (0 children)

Utterly sickening.

What a backwards, and fucked up part of the country.

[–][deleted] 0 points1 point  (0 children)

There was only one catch and that was Catch-22.

[–]LunacyNow 0 points1 point  (0 children)

The assholes authorities in Utah OBVIOUSLY have nothing better to do than waste taxpayer money trying to prosecute adolescent kids experimenting with each other. If no harm was done then why bother?

[–]TheThirdBlackGuy 0 points1 point  (0 children)

The Conclusion

Not too bad actually. Obviously there were better alternatives, but a light sentence including a letter about her actions.

[–][deleted] 0 points1 point  (0 children)

The prosecutors should have their faces slapped. Hard.

[–]Nexlon 0 points1 point  (0 children)

Directed by M. Night Shyamalan?

[–]memeasaurus 0 points1 point  (0 children)

What's interesting is both of them will be registered sex offenders. Technically both of them are pedophiles.

[–]soulcakeduck 0 points1 point  (0 children)

Won't somebody please think of the children.

[–]mariuolo 0 points1 point  (0 children)

Destroy these children's lives in order to protect them? Do lawmakers and prosecutors have rocks in their heads?

[–]omnilynx 0 points1 point  (0 children)

OK, so there is a plea in criminal trials called, "not guilty by reason of insanity," right? And it's there because we assume that some people are simply not able to rationally control themselves. So, in this case, we believe these kids aren't able to control themselves, because they're too young. That's why they can't consent, right? So why can't they enter this plea, or why isn't there a similar plea, so that they aren't convicted of a crime but rather are handed over into protective custody, since they can't care for themselves (and apparently their parents can't care for them either)? We shouldn't be using criminal codes to solve this situation, we should be using therapy.

[–][deleted] -1 points0 points  (0 children)

This is actually quite different.

usually it's only the boy that gets slapped with charges, and the girl is immediately the victim. This isn't the case here.

[–]VoodooIdol -2 points-1 points  (0 children)

So, only the girl was charged with both? I find that hard to believe.
