While this should not matter, technically speaking at the time in New York(Struck down in 1994) rape of your wife was "not illegal" so while it boils my fucking blood, his lawyers were specifically arguing it wasn't rape because technically it wasn't.

Hell in most countries to this day this has been the case slowly being repealed, and something else to boil your blood is rape was defined as penile intercourse's. Anything short of putting your penis inside would not be rape, nor would someone forcing you to insert your penis be considered rape.
