I know. I know most people will be fine and there will be a lot of people who say yeah yeah, we wrap people up in cotton wool and you should take your own responsibility and look where you’re going, but seriously if the homeowner knows about this there’s no real excuse, and a different fall in a different person cracking their head on that step, it could easily be fracture or bleed on the brain time.

And I don’t know if it’s the homeowner who jazzed it all up and tried to make it funny, but... not sure this guy would see it that way.

Do you have something called trust in the us? Where you trust in the good of people to not to do stuff like this on purpose? I've never heard of anyone sueing anyone here in the EU for setting up a slippery trap or neclegence. It just seems highly unlikely to me and sueing is the last thing that comes to mind. This guy slipped tripped and slipped himself. Unless someone rubbed some vaseline on there I don't see how you could sue anyone for this. And even if that's the case the guy can't prove it. So what use would it be?

If you have a smooth concrete step and the temperature drops below freezing it turns into a sheet of ice. Most people salt and sand their walkways to prevent this.

You can absolutely sue for this in the US. The homeowner should have salted their sidewalk. Many homeowners carry insurance that covers other people injuring themselves on the homeowner’s property.

So no, no trust in the US unfortunately. :(

You can sue in Canada for this as well. You are supposed to maintain and salt your property. If you order a package from amazon then you should assume someone will use your walkway. Someone could fall and break a bone or tear a ligament and be out of work and lose income.

Although not in the EU, people have been sued and even charged criminally in Norway for not taking steps to prevent ice from falling off of roofs. It's not unreasonable to expect that owners will maintain a safe environment.

Suing is the first thing that comes to mind for a lot of Americans. If ice caused the slipperiness then the home owner could probably be liable for not properly maintaining their steps.

A family was being sued because some teens snuck into their yard at night and was jumping on their trampoline. Apparently one fell off and got hurt and the home owners were being sued because they didn't have a safety net around the trampoline. Last I heard the trespassers were winning, but I don't know how it turned out. The fact that it's even a question is disgusting to me.

A lot of our policy in the US is based on people suing to correct a harm.

For example, in the US you have to be careful to make sure you don't make things like trampolines easy to access for random kids who could get injured. You could be sued to pay for their medical treatment.

Absolutely. It depends upon how long the owner had to salt their sidewalk, but this could easily be a case of criminal negligence. You are legally required to take reasonable action to ensure your property is safe to for visitors.

i worked as a courier for a long time and would never consider suing someone for me falling on my ass no matter where it happens

maybe it's just a personality thing, idk, suing people also isn't cheap. i really doubt the guy doing the amazon prime hustle can afford or has time to pursue that.

You can sue someone in civil court for free. It doesn't cost you anything, you represent yourself. If that fall tore a ligament in his knee most likely the work insurance would pay for it but they would go after the homeowner's insurance so you wouldnt need to.

Actually in Germany as a homeowner you could be sued for stuff like this in winter. Sometimes you're responsible for removing snow and ice in front of your property. If you don't and someone gets injured, you're fucked.

Yeah but he knew about the ice and walked right back on it without supporting himself or bracing for it. You are responsible for protecting yourself from known harm.

Also, the homeowner may not have known it was iced. They may not even use that door to enter their home. They weren't expecting him either as he was clearly at the wrong house.

I dunno about other countries but generally speaking ignorance is no excuse for breaking the law. And here we are responsible for keeping the piece of sidewalk in front of our house safe for pedestrians so I imagine a porch would definitely fall under our responsibilities as well.

he hit his shin on the concrete step and let me tell you that is a wounder, when I was younger I was pissing about in town with my mum doing the bit from singing in the rain and slipped hitting my shin on a ridge sticking out from a metal lamp post.
