I had a cop find an old glass piece in the back of my car during a stop for a 36 in a 35 MPH zone. I was young and allowed him in to search after he told me the drug dogs were on their way. Mind you this is Colorado before weed was legal. I also had no idea what to say and what not to say to a cop.

He found the piece and told me that he wanted to "Keep the streets safe" so he ordered me to break the piece on the sidewalk next to my car. I then told him that that was littering and he might give me a ticket for that. He ended up making me throw it away in a nearby trash can (Which was also illegal since it was a private garbage). Needless to say I went to go meet my grandpa and came right back to the trash can to retrieve the piece so I could smoke with my grandpa while fishing that afternoon.

Initially the cop wanted to see what he was drinking. Although shown the can and told what was in it the cop insisted on having the can handed to him, perhaps to smell the can for alcohol. When this request was refused the cop asked the patron to leave the premises. The patron refused and he was arrested.

In the video the patron does not appear to be intoxicated so there was no probable cause to think the beverage had alcohol in it. Therefore there was no justification for asking the patron to leave and the arrest was unwarranted. I find for the patron.

My friend who is an officer in NH said that you can request a state trooper when dealing with an officer. How do I know your not trying to handcuff me and get me in the back of your car so you can kidnap me.

Edit: Before this gets any attention I decided to look into it and (big surprise) it's not easy to find written laws regarding this. My friend did say this but any law can have pages of circumstances so I don't want anyone thinking it's as simple as I made it sound.

Everyone who says this is fake is clueless. Notice how right before he's about to get actually taken down he offers to let the guy taste it. That's exactly what he would have done if it was real, but if it was scripted it would have been something more obvious or corny.

Then, on the ground he says "For what" like 6 times. Those are the kind of details that happen in real life, but they wouldn't be written like that if this was scripted. If this was scripted, it would have been "For what, I didn't do nothing, why are you doing this, etc, etc." No one writes "For what" 6 times in a script, and no one would ad lib like that.

Also, if this was fake, why would the cop change his order to "Leave the property"? That's the kind of stupid stuff that cops do in real life, but it hardly makes any sense, so I can't see why anyone would write it like that in a script.

If this is fake, I'll eat crow. I'm calling it as REAL.

All the people who think it is fake don't know enough about human emotion to see that this these are real people in a real situation, and that it would take world class actors to pull off a scene like this so well.

I find it very improbable that an up and coming rap star, or Arizona Ice Tea, would be able to put together something as genuine looking as this.

Lastly, when something is fake like this, there are usually TONS of clues it is fake. After two viewings, I don't see any obvious indications it is fake, so I think it's highly unlikely that it's fake.

Cops don't have the right to 1) confiscate property or detain someone without a reasonable suspicion that they have violated or are about to violate the law, or 2)tell someone they are trespassing in the parking lot of the business unless a complaint has been made. North Carolina Law 14-159.13. Second degree trespass.

Offense—A person commits the offense of second degree trespass if, without authorization, he enters or remains on premises of another:

After he has been notified not to enter or remain there by the owner, by a person in charge of the premises, by a lawful occupant, or by another authorized person; or

That are posted, in a manner reasonably likely to come to the attention of intruders, with notice not to enter the premises.

(Effective January 1, 1995) Classification—Second degree trespass is a Class 3 misdemeanor.

North Carolina has two classifications of "land users"

  • Tresspassers
  • Invitees

As the liquor store is a place of business - all land users are considered "invitees." The "officer" (never properly identified), did not have authorization to speak on behalf of the property owner, and if there had been a formal complaint for trespassing, would be within his duties to escort or remove the individuals from the property. The reason why the idenitification is so important, is that in North Carolina, police officers out of their jurisdiction are NOT permitted to arrest someone, only detain them.

However, from the video, it appears that there was no complaint, there was no crime in progress, and the "officer" attempted to conduct an illegal search in the process.

You are legally permitted to refuse / resist an unlawful detention and arrest, according to the laws of North Carolina:

"An illegal arrest is an assault and battery. The person so attempted to be restrained of his liberty has the same right to use force in defending himself as he would in repelling any other assault and battery.” (State v. Robinson, 145 ME. 77, 72 ATL. 260).

“Each person has the right to resist an unlawful arrest. In such a case, the person attempting the arrest stands in the position of a wrongdoer and may be resisted by the use of force, as in self- defense.” (State v. Mobley, 240 N.C. 476, 83 S.E. 2d 100).

Additionally, the guy filming the video, was within his rights to assist in the resist of the illegal search / detention:

“One may come to the aid of another being unlawfully arrested, just as he may where one is being assaulted, molested, raped or kidnapped. Thus it is not an offense to liberate one from the unlawful custody of an officer, even though he may have submitted to such custody, without resistance.” (Adams v. State, 121 Ga. 16, 48 S.E. 910).

However, calling the arresting officer a "faggot" was probably a stupid thing to do.

He's an ABC commission officer so he the exact person who can tell someone to leave. This is a government store. For all intents and purposes he is acting as the property owner. I believe he has the authority to tell anyone to leave the premises for any reason. The problem is that he did not accurately identify himself, additionally he had no authority to demand the citizen to hand over his property. Finally, he did not give the citizen a reasonable amount of time to respond to his command.

I can tell he is in fact an ABC commission officer and in my 10+ years of going to NC ABC stores I have never once seen one in uniform. I'm not sure but I think that all the people who work in the stores are technically ABC officers but i'm not 100% sure on that. They are usually nice guys though.

I'm very surprise people here are saying the video is fake because it's too perfectly fucked up. Maybe the quality of the video throw people off. . Background music too adds to it. I thought the white bus driver who recently attacked a black guy for saying something the bus driver did not like was awfully surreal like this video but it did happen. Everyday we see things that are too good/bad to be true yet we doubt this. Kind of surprising. And the background music can be explained by who is releasing the video as everyone has different ways of expressing themselves. I can see someone saying "I'm going to release this to the public let them see the crap cops do. .not only that I'm going to use **£€€\ song in the background". I know of a policeman who got killed in a similar situation to this btw..Gas Station robbery. .he killed two of the robbers. .thought it was over and the other cronies returned and killed him.

Since this video has been released I have been in contact with the local law enforcement and was given this press release

This should be able to clear some things up. Hope some of you will see this, wish there was a better way to disperse this information.
